今天我的同事说我赢了给某个租客加租和赶他们走的案子。
上周初我的同事代表我参加NCAT hearing 不被接受,说要有书面授权,然后推迟了一周左右重审。到9号再出庭。我有很好的理由请同事代表我,因为我已经不在澳村了。于是写电邮附上机票而且7号早上那天出发前打电话确认了同事可以代表我。
当时那个Tribunal Member 发表了一通站在租客那边的极左言论,说我加租太多,说不可以因为报复因素赶走租客,说租客不必在给定日期前搬走,我得另外申请order 赶他们走,说有的房东以为可以为所欲为但是租客有他们的权利云云,同事转述给我听,我简直要被气死。幸亏我另有更加重要的事情要考虑,所以没有怎么去想它。
今天同事给我的信息:
They nearly didn’t let me represent you again. I just pushed & pushed. The tenants were trying to assert their authority stating you had not provided them with evidence you have been financially impacted by Covid. I explained it is not their right to seek such clarification & your finances are not relevant to prove with respect to the notice to increase. They have to pay the rent increase as at the notice date & the have to vacate by the notice date. Liam pretty much had a little tantrum & hung up on the tribunal member after the verdict had been given.
Q****! 租客要求减租才需要提供证据说自己的财务状况被疫情影响了。这个租客恬不知耻竟然反客为主要求我提供相关证据表明加租合理。真以为他翻身做主人了,不必尊重私人财产了! 而且他们明明知道租约一开始的租金就大大低于市场价因为卖房开放啥的,年初我还看在他们要生小孩的份上没有给他们加租。结果他们完全不懂得感恩,也不搬走,非要上NCAT,浪费我的时间。我实在对他们太恶心了,不愿和他们打交道,于是准备了文件请同事代表我。
今天这个 Tribunal Member 应该不是那么极左,明白私人财产业主的基本权利。所以判我赢了。有时候真是坏事变好事,上一个脑子坏掉的Tribunal Member 不让我同事代表我,结果后来运气好碰上一个脑子正常的Tribunal Member.
