前一段做花园,现金交易工程完工但还有几千块没付有争议。因为其中一项106平米用了我140平米的砖要收148平的钱。以及等等莫名其妙的费用。喊他来测量他不来。昨天发email说拿不到钱就要撤我的车道。我还专门跑到警察局问了下,回答他可以拿。简直疯了,不知道怎么办。

以我的实战经验,10%左右的损耗,瓷砖或地板,切割量大,边角多的。车道铺地砖,肯定低于这个损耗。放心,也就是吓唬你,不可能把车道的砖取走。

the trade person will be trespassing if he came onto your property without your consent. you can call the police and tell them someone is trespassing .
if he proceeded to remove the bricks, then it will be trespass to property. you can sue him for damages as you will need to hire someone else to fix the driveway.
he can not take those bricks as they are in your possession. if the trade person has dispute about the payment, he should sue you in breach of contract. not just taking the bricks.

不了解法律,麻烦你给个出处可以吗?凭经验不太赞同你说的,我们的客户在尚未付清全款之前我们都是有货物主权的,可以去他们仓库把货拿走的,当然这是写在报价条款里的,楼主这种现金交易不知哪个法规可以约束?

今天我铺了20多米driveway,现金哥临时加价700刀,我想想算了,现在光景不好,不跟他啰嗦了。我猜LZ也是类似工程干一半临时加价,再加铺个道砖头乱算,几千块尾款没结。

Trespass这点很重要,建议立即按摄像头,同时短信/邮件通知tradie不要进入你的property。最后还是希望楼主能和tradie友善协商怎样解决最后这个小问题。

you can not enter other people's property without their consent, or it will be trespass.
if you believe they have in their possession that something belongs to you. then you should first ask them to return it, if they refuse to do so , you can then sue in detinue. or alternatively breach of contract.
intentional torts are mostly common laws. i will have to look up relative cases if you insist.
nevertheless, basic law principles are as I mentioned above

我们自己铺了几次地砖,损耗确实大,尤其是某些施工人数学不好的时候,经常不计算怎么节省料,所以第二次开始我们测量好画好图,定了地砖尺寸后,直接在图上标注整砖某区域多少,怎么铺,然后边角怎么切一块一块整的几个小块,各自往图里abcdef等地方放,就差自己铺了。后来到50平方以内室外的就自己铺了。室内的瓷砖只能找工人铺。

这是一个很奇怪的人不想报价不收定金。我催了他很多次才报了铺地的单价。其他项目的价都是做之前问他,口头报的。因为他是一个大砖厂的contractor,相信他技术不差。做工还好就是有些砖缝没封好。付款更奇怪,每次都是我过一段付一些钱他。像是请他收钱。工程完工后,我问他要bill ,他不理。倆个月后才给账单。6 万 加 1万我买砖的钱。

这种事警察是管不了的,要找对管他们的政府部门例如:
维州找 Victorian Building Authority https://www.vba.vic.gov.au/
昆州找 Queensland Building and Construction Commission https://www.qbcc.qld.gov.au/
其它州都有类似的部门负责给他们发license的,对了你可以随便查查他没有license。
在昆州,如果工程包工包料超过$3,300一定要有license,否则违法,一通电话打到Queensland Building and Construction Commission举报就行了,剩下的QBCC都会搞定了。
