买的楼花,今年一月settle的。当时律师给的settlement statement, 上面说vendor已经预付了一年的council rate, 我settlement的付款中包括从settlement date 到6月30日的council rate。 但是4月收到了council的通知让我付council rate 澳币575, 根据最近收到的第二年的council rate 通知估计575包含第三次没有及时付的罚息吧。我联系了council 说vendor应该已经付了,但是他们回复说没有收到。我问我的律师,她们确认应该是vendor付,并且也联系了vendor的律师几次,对方也说会通知会计部处理,但是就是没有下文了。5月收到council 通知说如果6月15号不付的话会转给第三方收账公司。我的律师建议我先付,然后向vendor要回来。但是过了一个月仍然没有消息,我又联系律师,她们建议我要不找fair trading处理。我第一次申请,fair trading回复说这事不归他们管,建议我去电话咨询一个法律机构,我又向fair trading第二次申请,这次一个女士给我电话也说不能处理,但是建议我因为是settlement没做好,我可以投诉律师。但是我觉得之前律师还是挺负责其他问题的,我估计律师疏忽了查看vendor 的付款记录。所以我不是很想为难我的律师去投诉她们。我想请教一下大家如何处理,继续联系我的律师让讨要我的代付款还是其他处理方式。

这是对方律师的错 因为楼花的adjustment都是developer side做的 但是如果你律师够负责的话就会申请certificate跟council确认
你不能直接问他们追讨 要你律师去要....你只能催律师

我的律师也是这么建议的,所以我6月15号就付了,但是我后来问律师,这样答复:“We advise that we have attempted to contact the vendor’s solicitor several times from 25 June to 8 July and forwarded them the below correspondence on 30 June. We were able to speak to the vendor’s solicitor on 8 July 2015 and were told that all correspondences have been forwarded to the vendor and “the vendor ‘has not objected to’ the claims for reimbursement”, however, we note that the vendor has also not appeared to acknowledge or represent when they intend to make the reimbursement if at all.” 看样子不乐观啊

多谢啊,那就是我理解fair trading 错了,他们是建议我可以向fair trading投诉vendor的律师吧。

我忘了说了这件事不止我一个,起码我认识的另一层一个ABC也是这样,另外律师还回复说:“As the council has been sending letters of reminder and may charge interest if rates are not received, we advise that the current best course of action is to please pay the rates as soon as possible while we now pursue the vendor for reimbursement. We advise that we have spoken again to the vendor’s solicitor and have concerns about the time it may take for payment to otherwise be made by the vendor; we have been advised that the other lots in this development have been likewise affected and are similarly awaiting reimbursement.” 估计还有不少户都这样。希望其他足友以后settle的时候要注意这类事情啊。

下午收到我律师的回复:“Unfortunately despite our efforts spending a lot of time chasing up the matter and repeatedly contacting the vendor’s solicitor, we have not received any positive response regarding reimbursement. It is possible given the lack of action that the vendor is not prepared to pay; the vendor’s solicitor was not clear about whether any fellow owners of units in the development had been paid.
As previously advised, if you wish to sue the developer for recovery of the amount in a local court, we would be able to act for you. However, we would charge fees of $277.20 for costs in preparation of the process or $401.28 if it proceeds to default judgment, in addition to court filing fees.” 大家觉得我是应该继续向fair trading投诉vendor的律师如何。

还有是不是我应该先让我的律师通知开发商律师我要投诉他们了。各位足友还有啥建议啊

之前楼花遇到和楼主一样的问题, 开发商虽然预付了水费和council费,但是和实际上账单的金额还是有出入的,settle以后 council发账单来要求补交,转给开发商的律师,对方也承认是他们该付的钱,但就是拖着迟迟不付,前后找了好几次都没动静,最后也是听自己律师意见先垫付后,再问开发商去要回来。
还好最后开发商还是把钱还过来了,只是过程拖了很久

看来我不是一个人遭遇这种情况啊。当时council打电话来各种追债,我就是不付。最后每周50块把这些付清了。开发商也没还给我钱,用其他的形式补偿给我了。

我们也一样,要了半年。我们的律师也不给力。后来房子卖掉了,只能把所有outstanding 的付了。Fair trading 和law society 都不管用。浪费太多的时间和精力了。

我想先投诉开发商律师,不行再考虑我的律师吧,好在fair trading多投诉几次也没事。

今天在town hall火车站2站台居然看到了这家开发商SH international 的广告,看来他家还有新项目啊,要买的足友们吸取我的教训吧,跟这家开发商打交道小心点吧,这点小钱都贪

不少楼花都有这个问题 你的律师跟着合同settle没有问题 只是开发商拖着 要不自己付了 要不就起诉开发商讨债
