最近在看房子, 其中有一个前后院的房子,邻居在前院卖的房子在后院, 两家共享一个share driveway (如图)
1. share driveway
出售的房子前面是个open car space, 我的设想是能否在与car space平行的界上建一个电动闸门, 这样可以把车位和房子都包括到闸门的后面, 安全性高一些。但是如果这样建的话闸门会重叠到share drive way 上 (如图红线), 请问这样是允许的吗?
还有合同上share driveway 的面积也算土地面积之内,所以是需要我负责还是两家一起maintain 这个drive way 呢?
2. easement
房子前面有easement ( 标注C), 现在是open car space和一部分花带。 请问这个会有什么影响吗?

3. Positive covenant
合同里有提到这个,好奇为什么会与council 搭上关系呢?
The Registered Properties of the burdened lots will at their own expense well & sufficiently maintain and keep in good and substantial repair and working order in accordance with dimensions approved by council any on-site detention system ( which expression shall include all ancillary gutters, pipes, drains, walls, kerbs, pits, grates, fittings, tanks, chambers, basis and surfaces designed to temporarily detain water)
Where the registered proprietors of the burdened lots fail to maintain the system in accordance with the above and fail to comply with any written request of the council within such reasonable time as nominated in said request, the registered proprietors shall meet any reasonable costs incurred by the city council in carrying out works necessary to maintain the satisfactory performance of the system.

Abcd面积是共用的地方,谁都不能加建。两家一起维护。面积一般都是留够车子进出转弯倒车等需要。
