买的房子如果在做Final inspection 时候发现小问题不少,比如地板不齐,窗不密封,可以以这个为理由拒绝settlement吗?

一般合同裡面都有條款約定必須先settle然後再解決問題。
這些合同都是industry standard的,所以這些小問題一般是不能不收房的

有朋友找 Metricon 建房,之后找 independent inspector, 朋友是等 Metricon 改好一些 report 里的大 defects 后才付尾款!
我觉得地板不齐是大问题, 一定要改后才付尾款!
尾款沒付清,Metricon 也不可能把新房 hand over!
最后好像遲了兩星期才 hand over。

这些问题一般不能,一般合同上说的都是除非面积差异超过%多少你可以退出合同,其它的都只能用3个月的保修来处理,我说的是公寓,自建房就不懂了

It depends on the contract you have signed.
我簽的是 HIA standard contract, contract 里是要求 builder 改完 known defects 后才 pay final claim (final payment).
一旦付了 final payment, 要求 builder 改就烦( builder 通常拖)。
以下就是部份 HIA standard contract 的內容。
Completion and Handover:
Under clause 36, when the builder considers the Works
have reached “Completion” he must give the owner a
Notice of Completion and the Final claim.
The builder and owner must then meet on-site within 7
days of the owner receiving the Notice of Completion and
Final Claim, to hold an inspection (clause 36.2).
A written list of known defects and incomplete items is to
be generated at the inspection (clause 37) and the builder
must carry out work to rectify defects or complete items in
order to reach “Completion” – and serve a written notice
when this has been done. The owner must then pay the
Final Claim within a further period of 7 days.
Note that the builder must not demand final payment (the
Final Claim) until the builder has given to the owner a
copy of the Occupancy Permit (or the certificate of final
inspection).

二手房一般都是sale as is,除非有證據證明你看到的瑕疵是從簽合同到settle那段時間造成的損壞,否則沒辦法延遲settle,也不太可能要求補償的

Just tell your builder you will only pay the final payment only if they fix the defects(or at least the floor's tiles) in the report.
There is no way you can put your furniture in the house if the floor's tiles are not fixed

Make sure you have a proof that you have sent the defect list to your builder before the 3 months warranty. 如果 builder拖了很久也不修,你可以上court要他们赔錢。

我的 contract 上写明 fix 完 known defects 才 pay final payment。
如果我和 builder 都 sign 了contract ,任何一方不 follow 就是 breach the contract, 可以经法律追究损失的。

Making final payment
The building project is complete, and you make the final payment, when the work is finished in accordance with plans and specifications and the Occupancy Permit has been issued (for a new home) or a Certificate of Final Inspection has been issued (for an extension or renovation). The builder is not entitled to the final payment until then.
You can pay an independent building consultant to check for defects or unfinished work, and to advise you of any issues which have affected completion of the project. If you have concerns:
make a list of any work that you believe is faulty or incomplete
speak with your builder immediately about your concerns
put your request and any agreements made with the builder to finish work in writing, and send it by registered post.

其實我 builder 在未出 OP 之前已 push 我 pay final payment。Builder 还扬言如不pay immediately, 他们要收 interest。
於是我 contact Consumer affairs victoria, 后來我被 transfer to another department,
他们告诉我 by laws 我是不需要 pay a cent (before the OP is issued and all works is complete)。他们还教我如果 builder 不 finish fixing defects, 我可以hold 起部份 final payment(自己 estimate 那些 defects 的 fixing fee)

起码可以先拒绝,看他们的态度如何,一般建筑商都会搞定的。我以前建房建筑商的态度我还是很满意的。一些小问题在settle后也都第一时间解决了,而且不止一处,查出来立即电话,那边就过来修

记得合同里好像有一条说,如果修理费用超过总成交额的一定比例的话,卖方可以要求取消成交的。
利用这一条,可以要求卖方修理完毕再成交。
有的时候,卖方会嫌修理费用太高,而决定取消成交的。
