本人在墨尔本,上年买了一个off plan TOWNHOUSE,是一块地建2个townhouse那一种,今天收到occupancy permit,然后Builder现在去弄plan of subdivision的事情。想请问一下,不知道land subdivision 一般从申请到批下来要多久呢?这个房子settlemment已经推迟了半年,真是人都快疯掉了。

Council need to issue the Statement of Compliance first, it generally take about 3-4 weeks, if the developer get all the condition of Plan of Subdivision permit ready.
Once the statement of compliance was issued, the developer's solicitor / land surveyor will lodge the title registration to title office, it take about 10-14 days, to issue the title
then according to the contract, the developer need give you 2 weeks notice for settlement. While you can waive this 2 weeks notice period, can settle the land as soon as the title was registered

要看你的builder 什么时候开始申请subdivision
如果subdivision 的planning permit 都未做的话,那就麻烦了

Council 要批那个statement of compliance 才能拿到titles office 申请
他们一般都不会看你有没有certificate of occupancy,要council 自己的town planner 跟工程师做检查

occupancy permit 在这个时候对subdivision没多大关系了。应该还要差不多6周到8周时间。town planing 和 subdivision跟builder没关系吧,一般是owner自己做。3楼解释到位

同样的问题,在悉尼买了刚建好的房子但是还没有register。已经有builder的final occupatio certificate.请问planing permit是不是房子建好了才可以申请?谢谢!

I just reviewed my contract of sale, there was a planning permit in section 32.

I just checked the council website, my purchased property was lodged for subdivision application but it hasn't been approved.

Yes, I think they need to get the building and planning permit before the construction. I think we are in the same stage now.

Well, the special conditions on sales of contract says vendor need to get things done within 6 months.
I wish it will not take that long, as there will be more risk for us.They also need to get Statement of Compliance done, so that means 1 month for subsdivision application and 1 month for Statement of Compliance plus final registration with LPI. If everything all right, it will take around 3 months.

It is okay if they do things to get property registration. The only concern is that they change mind and delay it on purpose.

看owner跟builder签的合同是怎么样,如果是全包。那builder会把oc和statement of compliance都做好给owner才收尾款。一般builder有自己的planner,oc拿到后compliance certificate很快就有了。我们的项目就只有3天。然后马上发oc给surveyor做subdivision、surveyor资料齐了以后就反馈给律师,律师直接lodge title application。迅速的话就是2-3周,慢的话没法说。

翻出这个旧贴问下,vendor的律师告诉我们律师这周会出op,2周后settlement,但这周没信都。
这个op一般会多久下?
如果拖延了,是什么原因呢?

据我所知op是building surveyor对房子建的都满意了就出的,apartment会复杂些,有时还要牵涉到消防局的视察
