信的内容如下
We write to you concerning the easement for access and maintenance registered (easement) registered on the title to your property at lot 2020, which burdens the property neighbouring you at lot 2021.
The easement is necessary only in circumstances where the dwelling constructed on your property has a zero lot wall, as it allows you to enter upon lot 2021 to access and maintain that wall. We note the easement is not required for your property as the dwelling to be constructed on your property does not have a zero lot wall along its common boundary with lot 2021, therefore, the easement is not required and there is no detriment for you in releasing the easement. To demonstrate this, we enclose a copy of your site plan.
When the developer registered the subdivision plan to create lot 2020, the developer incorrectly registered the easement on lot 2021. As a result, the dwelling approved for construction on lot 2021 encroaches upon the easement, accordingly the easement need to be released.
It will be also necessary for your mortgagee to consent to the release and produce the certificate of title for lot 2020 at land and property information, we recommend that you forward a copy of this letter to your mortgagee, the developer has agreed to meet your mortgagee’s cost.
