最近毕业找了一个工作,是sub-contractor。老板直接打工资到我的ABN上。工资是按照小时支付的,但每周工作时间长度不一。老板说我这样工资支付好,我还可以抵税。但我查了相关资料,发现我根本通不过personal service income,因为我全部收入来至于一个公司。所以我肯定是不能抵税了。但是super这块,我觉得应该是老板帮我交吧?还是我自己交?在政府的规定里,我到底是part time employee还是contractor啊?

abn就是当你business,相当于外包,一个月好像是工资过450自己交,在家办公之类确实可以抵税,非专业

Thanks. The link provided above is the decision tool for employers. As a employee, I can't answer some of questions as I do not know how the business runs. It seems I can't pass PSI test and I can't get tax reduction like other small businesses. My concern right now is if I can get my super back from my employer.

对照一下六个区分的重点,如果是employee,他们不光要交super,还必须有annual leave等entitlement.
• ability to sub-contract/delegate
• basis of payment
• equipment, tools and other assets
• commercial risks
• control over work
• independence.

往ABN上打钱应该是contractor吧。然后对于该项业务的一些支出都可以拿来抵税的。老板其实就是为了省事,contractor对他老说方便。

法律不是按照是不是有ABN来界定的,否则人人申请一个ABN,然后申报tax deduction了。雇主这样做完全不合法,貌似为雇员省事了,其实更多的为了自己逃避super, annual leave, long service leave, payroll tax, workcover…………. 其他都是次要,万一工伤了怎么办。
类似的事后打官司的很多。

之前雇主也是和你说的一模一样,说是对我方便省事,而且还能退税,说多做多得。的确工伤什么的都不含,虽然去site的次数很少。一开始我还买了一些工作用品,以为能抵税呢。后来身边朋友告诉我有可能是没法抵税的,叫过来学习。结果发现还有个PSI的测试,虽然看得不明白,但是隐隐约约感觉我肯定是通不过的,所以是不能tax deduction。这样政府压根就不是把我当时small business看,估计还是当成employee。和雇主说的相反。看这情况,我还是想确认super的事情,能确定下来就和雇主谈去,9%不是小数目。

楼主找个会计吧。。。还有就是super要跟老板要,当时谈合同的时候就应该说清楚这小时工资是含super的还是不含super的。
老板不一定给你,不能接受你就准备跳槽吧。。否则还得干下去

如果你的工作符合以下六点或大多数符合,你就是法定的雇员而不是合同工:
Ability to sub-contract/delegate: the worker cannot sub-contract/delegate the work - they cannot pay someone else to do the work. 雇员不可以分派工作给其他人。

Commercial risks: the worker takes no commercial risks. The business is legally responsible for the work performed by the worker and liable for the cost of rectifying any defect in the work. 谁对最终产品质量负责,比如造房子,由建筑商负责而不是建筑工人对房主负责。
Control over the work: the business has the right to direct the way in which the worker performs their work. 雇员不能更改工作的流程和进展。
Independence: the worker is not operating independently from your business. They work within and are considered part of your business. 业务的独立性,雇员不经营自己独立的生意。
个人估计,楼主deemed as employee。你找雇主谈,很可能被炒掉,对方这样做显然是完全为了他自己的利益。总工资超过7500,雇主就必须购买工伤保险,如果没有买而员工受伤了,WorkSafe是会代为支付治疗等费用,再向雇主追索。
你买工具之类的费用,即便收入属于PSI,也是可以抵税的。不能抵税的是诸如给家里人开的所谓工资之类的。
如果急需要收入,可以骑驴找马。如果不是急着这些钱的,建议还是不要干了,这样的老板和7/11的黑心老板没区别。再狠一点的,先干着,然后去告他...........

谢谢告知信息,基本确定应该是employee了。还挺缺钱的,刚毕业不久要独立了,而且还要买房中。我肯定是不会告的,因为自己真的学到了很多东西,还是感激有这次机会。自己酝酿酝酿一下,看看以什么比较艺术的方式和老板谈谈,客气的要回super。

Superannuation 和 income tax (PSI)对员工的定义有所不同。但相差不大。
你这种情况雇主是应该付Super的。
唯一的例外是你用公司形式给雇主提供服务,那Super就不在考虑之内。

和会计去谈,第一反映,你的老板占你super便宜,我看着非常反感。他这样子一个电话举报就嗝屁了,怎么这么多无良老板的,总在super salary上打主意!

我感觉老板就想图个简单。如果你是刚毕业的,估计也没什么回旋余地。最多把现在的pay改成package incl super,这样你实际到手的钱肯定就少了。
