问一个基本问题,如果自住房refinance增加了贷款,然后转成投资房了,那么可以抵税的那部分贷款,是按原来的outstanding balance还是可以按增加贷款额后的?

谢谢楼主。我有问题:
我们去年与中介签订了一份租约,打算租用一个他们代理的发展商开发的factory, 去年12月交付了定金,厂房目前还在建设中,原来预计今年6月1日交付使用。
最近我们引入其他投资者,公司股权发生了变化,董事会成员也有相应变化,经过讨论,决定不再租用这一新厂房。我于月初通知了代理。
但由于当时我们要求厂房必须有gas,所以,发展商已经为此多投入了一些资金,我的问题是
1)我们应该为此赔偿发展商吗?赔偿多少呢?
2)我们应该赔偿代理公司吗?多少?

A cancellation of a lease agreement would be a breach of contract The general law on contract is that the party cancelling the contract would pay compensation to the other party for any losses or costs resulting from the breach of contract. However there may be clauses in the lease agreement that may say something different, therefore you need to read the lease agreement to see if there are clauses on how compensation can be determined.
Therefore:
- For any costs for the installation of gas, there are costs involved and therefore the landlord will likely to ask for compensation. However it is possible to argue the landlord has not suffered any loss if any other tenant would have requested gas installation anyway.
- For the agent commission, the agent probably cannot get compensation from you directly as you do not have a contractual relationship with the agent. However it is likely that the agent would seek to receive commission from the landlord anyway, given that the agent has actually succeeded in organising a lease agreement signed for the property and therefore has actually “earned” the income for the services performed by the agent to the landlord . If that is the case, the landlord would in turn seek compensation from you for the agency commission costs paid.

至于租赁中介费,一般这个是由业主来付,所以中介可能没权向你索偿(因为你跟中介没有直接的合约关系)。不过,这种情况下,中介会向业主索取租赁中介费(毕竟他们已顺利完成他们对业主的合约义务,就是提供中介服务和安排双方签订有关的租赁协议),然后业主会再向你索偿这笔中介费。

楼主好人!我前两天刚开帖问关于买车的事
我现在在看生意,但还没看到合适的,一直在看franchise
现在想换辆车,我可以先买车(以个人注册),然后买了生意,说车80%都是生意所用,拿到最多的CLAIM吗?
还是我要先有生意,再买车,才能claim depreciation?

可以先买车,然后到你生意开始的时候从 0% business use 变成80% business use 来算 depreciation.
要注意的是,基本上生意开业前的所有开支都不能立刻扣税,不过可以通过几种途径每年扣一部分(比如depreciation claim, blackhole expenditure claim)。
有个问题,分是干嘛的,有什么用?不知从何时开始我也有鞋了,冬天来了,雪中送炭啊。
