请教各位大虾一个关于CGT的问题:
本人在2010年 以个人名义买了一个Appartment (off plan), 2013 6月settle,同年5月,我老婆也以个人名义买了一个town house.如果我想把我的房子买了,可以excempt CGT吗?之前听朋友说,如果结婚了,再算Tax方面是一个entity,所以我的房子不属于main residential 的要求。是这样吗?
PS 我们是2013 11月刚接的婚,我房子是自住,期间也咩有出租!

自住房,没出租过,当然卖了不用付CGT。

你妻子买她那层楼时,有住过在里面半年左右吗?
有用过那个地址在头年买时用来报税表吗?如有,可采用六年exemption方式。在买来的第六年搬进去住上一年,用那地址报报税,第七年卖出,那就不给CGT。

In that case, ATO already thinks you were de facto before 2013, and only one main residence could be claimed. There is not much point to analyse further.
Moreover, in order to claim main residence exempt, one should reside in the property first. One cannot claim main residence exemption, if he bought the property off a plan and sold it after it is built without actually residing in it.

are you suggesting I should change the purpose of the property to investment, as we are married and the main residence exemption will be claim on my wife's property.
is there any way to save the CGT in my case?

If you have made your mind to sell the new built off-plan property, i would recommend that you and your spouse to move in and claim it as your main residence for a while before you sell it.
