hi there ..
I got a a question .. my boss record me as non resident..she insisted that i m non resident
..so my hourly paid was heavily deducted by almost 30 %!!
But i m pretty sure that i m a resident for tax purpose ,,
for the past three years i held a student visa
and since two months ago , i ve hold a 485 bridging visa A .
My question is can I claim myself as resident as the time i do the tax return ?!

Sure you can claim yourself as a resident for tax purpouses. As long as you satisfy the conditions of the tax resident. For example, if you stay in Australia for more than 6 months during the period from July 2011 to June 2012 you are a resident for tax purpose.
By the way, I don't think your employer over deduct tax from your wages. Generally speaking, 30% tax rate on salary package over $37,000 for Australian tax residents. (not sure about this)

well she paid cash .. n deduct 29 % from my cash paid ,,
at the time i was employed I signed that sheet n she said i m non resident ..
just in case i can still claim most of my tax back because my taxable income is >6000 pa

It is not up to the employer to decide if you are resident. When you fill out the TFN DECLARATION you should answer yes to the residency question. You employer would just have to pay you accordingly.

If the TFN has been signed by you, and sent out to ATO. It is more complicated case.
Tell your boss nicely: 'Unfortunately, i disagree with you about my current status of 'Australian Resident for tax purpose.', and i will contact ATO to correct my TFN delearation. Then, contact ATO sort it out (a bit challenging for non-accounting backgrounded person - if need help, just yell out).

she's a 俄羅斯 人..
for the past few months , she gave me payslip occasionally ...showing gross pay net pay super tax withhold
then gradually i received nothing .. ,,(just wondering if she still paying tax for me ..!)
i dun know if thats ok when i lodge the e tax ,,i claim myself resident..

there must be something wrong in this case, you better ask the ATO if you can alter the status from non to resident, or you can just check with ATO if it is ok that you claim resident as you are about to lodge your tax return. however, you need to prepare info to support your claim, and be aware, family tie and life style weigh more than you simply in australia for over 6 month.

是的,个人退税时会多退少补。问题是,每次被多交n刀税,影响生活的现金流。如果是我,我不同意。

when you do your tax return this year, claim as resident, after you have your NOA, tell your boss the Russian, and ask him/her to alter it back to resident from NON.
No reason that ATO accepts it but you boss keep claiming you as NON..

Good. Then, bring her to her supervisor. Ask for review. If you fix it up at that higher level, you might re-fill TFN declaration and send out with an expiation letter. If not, get your passport and visa certified and communicate with ATO to get a private ruling. 100 percent you will be recognized as 'australian resident for tax purpose'. I use my full quailed CPA membership to guarantee what I suggested to you.

i know shes using myjob to print out the payslip ..my last payslip ..
um already three months ago i reckon ..i could see certain amount of super indicate in the payslip ..!
does the employ contribute the super on a yearly or monthly or weekly basis ?and ..
how to determine whether the employer need to pay the super for the employees?

The residency tests we use to work out your residency status for tax purposes are not the same as those used by other Australian agencies for other purposes such as immigration.
Generally, you are an Australian resident for tax purposes if any of the following applies:
you have always lived in Australia
you moved to Australia and live here permanently
you have been in Australia continuously for six months or more, and for most of the time you have been
in the same job, and
living in the same place

If the employer paid you gross wages more than $450 per month, the employer must pay 9% super contribution to your nominated superfund quarterly. If you don't have your own nominated super fund, then you should ask your employer whether the company has set up staff superfund or not. They could submit super to staff super fund if the company had one.
In order to know whether the employer has contributed the money to super fund, you could ring up ATO superannuaton department for asking how long you would have to wait in order to claim super from your employer, and what form you would need to fill up. Make sure you have received PAYG Payment Summary for your wages received. Because it's an evidence to show you are the employee of the company. The super contribution must be made by quarterly.
