租约写了不允许sublease。但是房客只有一个人,所以也是准备他要分租的,准备睁眼闭眼当做不知道。
结果他写信给中介,问找housemate可以吗,新找的人S是否需要增加名字到租约上。中介回复需要房东同意,新加的人可以不上租约。
请问我应该怎么回复?我担心同意分租后,新来的人损坏房屋,然后我房客说你房东同意分租的呀你自己找新来的人去索赔呀。而且保险公司是否也会拒绝理赔?

你可以回不同意合约加名字,居住人数不能超过多少。

他还是会让朋友去住的
你也达到了房子损坏 他会负责的要求

任何他找的人对房屋有损坏都由他来赔偿。你只跟他之间有租约,他对sublease的人负责。合约不要加别人的名字

我回复了:
The sublease is not allowed as per my instruction to you and I believed it is stated on the tenancy agreement clearly, James is the only tenant of the tenancy agreement. On the other hand, I agree that the tenant's friend or relative can live in the property during their visit to the tenant (maximum 2 persons). If there is any damage to the property or common property caused by the tenant's friend or relative, the tenant will be responsible for the damage.

However, if the tenant wants to sub–let only part of the premises or take in a new co–tenant, you cannot unreasonably say no. You can ask for information about the prospective sub–tenant or co-tenant such as their name and details of their past rental history. You can ask that an application for tenancy form be filled out if you have one. You could also meet and interview the person, as you would do with a new tenant.

如果只是转租一部分出去,房东不得无理由拒绝
但是Residential tenancy act上还有一句the landlord is entitled to withhold consent if:
(a) the number of proposed occupants is more than the number permitted by the residential tenancy agreement

我先拒绝再说。如果房客懂法律,他坚持的话,我可以让他支付中介调查新租客的一切费用。我总有理由拒绝我觉得条件不够好的租客吧!
