我记得一起签合同的时候问过中介,中介跟我说提前90天给notice就好了。
现在原来的中介升职了,所以中介换了。然后家里有事,6月底老婆孩子丈人丈母娘都要来墨尔本所以提前几个月发了邮件,跟中介说我想六月底前中止合同(合同到10月)让租客搬。
中介说
“The tenants are in a fixed term tenancy until the 7th of October 2016 and we cannot ask them to vacate before this date as it is breaking their contract.”
”The tenant may be happy to break the lease and we can always offer some sort of compensation to her, i.e. one month's free rent. I can't make any promises that she will accept but we can always try.“
“Unfortunately due to the contract, if the tenant does not accept this offer, the earliest we can get them to vacate the property would be on the 7th of October 2016.”

一般就是和landlord说,重新找租客,广告费 letting fee你出,你住到新租客搬进前一天

是/租约到10月/要是自己搬回去/提早60天就可以了。换租客不续约需要120天提前通知/

The below is from ATO website
Amount of notice required
If you want the tenant to vacate you must give them a termination notice. The notice must:
• be in writing
• be signed and dated by you or your agent
• be properly addressed to the tenant
• give the day on which the residential tenancy agreement is terminated and by which the tenant is required to vacate
• where appropriate, give the grounds/reason for the notice.
You can write your own notice or use the model termination notice provided by Fair Trading.
The minimum period of notice you can give the tenant to vacate is:
• 14 days – if the tenant is 14 days or more behind with the rent or has committed some other breach of the tenancy agreement
• 30 days – if the fixed term of the agreement is due to end
• 30 days – if the premises have been sold after the fixed term has ended and vacant possession is required by the buyer under the terms of the sale contract
• 90 days – if the fixed term period has expired and no new agreement has been signed.

没戏,租约内卖房都不能终止租赁合同,除非跟房客商量,补偿一下提前搬

要是有足够理由证明他们违反合约多住人是可以赶走的,不过他们就是不搬你也没辙

中介是对的。

如果你合同上就写了2个人租,然后你现在发现有新的人住在里面,就可以以租客违反租约来要求解除合同。
