澳洲出租房的新规定???这是真的吗???

收到中介email如下:
Yes new laws from last year if you give the tenant a 90 day notice they could return the key at anytime, once they have vacated.

以前真不知道。是真的吗?哪里可以确认?

当然要保护弱势群体。

况且你下令让人搬走,哪能找到可丁可卯时间衔接完美的房子,按以前的规定房客就要损失钱。房东做的决定,为啥要房客买单?

我在nsw没听说过

只是租约到期ongoing后,你要租客搬走,要给90天通知,他们可以这段时间里面任何时间搬走

Ending a tenancy

1.        Termination notices
Under the new Act, a landlord or agent has to give at least 30 days notice if they want the tenant to move out when the fixed term period ends.

Under the old laws, this was 14 days notice, is that right?
Yes, that’s right. But this has been replaced by a 30 day notice period.

Also changing under the new Act is the notice period that applies when the fixed term has already ended. The landlord or agent has to give at least 90 days notice if they want the tenant to move out after the end of the fixed term.

Under the old laws, this was 60 days notice, right?
Yes, that’s right. But this has been replaced by a 90 day notice period.

The new laws also allow a tenant to leave at any time after receiving notice from the landlord without having to give their own notice. In addition, the tenant is only liable to pay rent until they return vacant possession to the landlord, and by that I mean they have moved out and handed the keys back.

Is this a change?
Yes, under the old laws, a tenant would have to stay until the end of the notice period or give their own notice and possibly have to pay rent on two places for a period of time.

So if a tenant is given 90 days notice after the lease has already ended, are they liable to pay rent for the whole 90 days?
No, the tenant is only liable for rent until they move out, which can be at any time during the 90 days.

Under the new laws, termination notices, and any notice for that matter, issued by either a landlord, agent or a tenant, can be hand delivered to the mail box of the other party.

So, is this a change?
Yes. It provides a speedy alternative to posting a notice through the mail because it avoids the need to add four working days to the notice period.

Another new change is that the Tribunal can overlook errors in the content of a termination notice or the way it has been served. As long as the Tribunal decides that the person receiving the notice has not been significantly disadvantaged by those errors, the notice will be acceptable.

The period of notice that has to be given by a tenant stays the same. A tenant will have to give at least 14 days notice if the fixed term period is due to end and at least 21 days notice if the fixed term period has already ended.

你这个回复很重要,别忘了LZ的原帖就是问这法律真实与否,与合理性没关系的。把歪的楼正回来了。法律有合理的也有不合理的,只要存在,就得遵守。抗法成本很高。

ongoing是要90天通知的,很多landord不喜欢,就租约到期问肯不肯续约,不续约就赶走。。。。。

Amount of notice required
If you want the tenant to vacate you must give them a termination notice. The notice must:
be in writing
be signed and dated by you or your agent
be properly addressed to the tenant
give the day on which the residential tenancy agreement is terminated and by which the tenant is required to vacate
where appropriate, give the grounds/reason for the notice.
You can write your own notice or use the model termination notice provided by Fair Trading.
The minimum period of notice you can give the tenant to vacate is:
14 days – if the tenant is 14 days or more behind with the rent or has committed some other breach of the tenancy agreement
30 days – if the fixed term of the agreement is due to end
30 days – if the premises have been sold after the fixed term has ended and vacant possession is required by the buyer under the terms of the sale contract
90 days – if the fixed term period has expired and no new agreement has been signed.
These notice periods are designed to give tenants reasonable time to find another rental property. If they can find a property sooner they can move out at any time without having to give you any formal notice. Except where notice has been given for the end of the fixed term, the tenant's responsibility to pay rent ends from the date they hand back possession, not the end of the notice.
There is no minimum notice period required if notice is given on the grounds of:
the premises being destroyed or wholly or partly uninhabitable
ceasing to be legally usable as a residence
being acquired by compulsory process (eg. by the RTA)
on the death of the sole tenant.
After you issue a notice you can issue another notice on a different ground if necessary. For example, if you issue 90 days notice to terminate a periodic tenancy without a reason, and the tenant then doesn't pay rent for 14 days, you can issue a non-payment of rent notice.

看了楼上Poweregg的跟贴,我觉得作为房主,可能租约到期坚持签新约好处多些,虽然租户只给14天Notice可搬走,换来的是房主不必要给90天Notice给租户。而且90天内租户随时可走,很被动。

新手,假设原租户不搬走签新约是合法的也是惯常的。

谁给个肯定或否定?!

之前有中介說過. 就算房東給了notice. 房客要是不肯搬.又準時交租. 房東也不可以趕走房客.

真的吗? 我的fix term lease过2个月到期。 我已经通知中介我要自己去住了。 那到时候房客不搬我也没辙吗?

如此說來。應該在租約到期前大約45日左右提出新簽租約。如果到到期前30日,租客不簽約,就通知租客在租約到期日離開。然後開始找新租客。

聽起來不合理。租約到期,你又提前通知了。租客應該必須離開。

中介跟我們說的時候. 我們的約應該是on going. 那時候我是二房客. 所以不太清楚.

他們的意思是房客按時交租. 房子的使用權是房客的. 房東是不可以強行收回的.

剛剛查了一下. 好像可以在法庭解決.

due date the only action you can take is to apply to the
Consumer, Trader and Tenancy Tribunal for a possession
order. You cannot forcibly evict the tenant yourself or take
action such as changing the locks or cutting off the water
or power supply. Heavy penalties and compensation
could be payable if you do.

不强迫收回,租期到了,提前给搬出/继约通知,要继续住就再签一张新合约,不住就搬了。这就可避免90天通知期这样的被动条款。这样通知期就总是在租约期内,好控制些罢了。

归根到底还是租客是啥样的人。

如果法律上与同一租户签新约不算另一合同的开始,而算租约过期的老样,那至少在很容易出租的地区或者租房紧张时期屋主可能会每6个月就换租客呢。我觉得这样的保护条款可能起到原来目的相反的作用, 租户每6个月到期就得搬,就是恶法了。也可能租户就倾向于签长约,不管原本是否打算租长期。 这样屋主愿意接受,到时给通知。不然屋主可能给别的愿签长期的租户了。

不是新的啊,是2011年1月31号开始就是这样实行的
合同内notice time 从14天延长到30天
合同外notice time从60天延长到90天
但是没有说房客不给钥匙可以继续住着!!

以上是房东想ending tenency情况
房客想终止的话是分别14天(合同到期前)跟21天(无合同)
