Pests and Vermin
You are not responsible for infestations if there is evidence that they were caused by the activities of tenants or their pets.
The tenant is required to take basic pest prevention methods such as proper storage of food and using sprays and baits.
At the end of the Tenancy Agreement while the law doesn’t specifically mention the cleaning of carpets or pest control, you may find that these are included as special terms in the Tenancy Agreement.
The following list sets out the circumstances and who would be deemed responsible for eradicating pests and vermin:
Ants
Tenant Responsibility – For eradication during tenancy.
Landlords Responsibility – Only if infested at commencement.
Bees and Wasps
Landlord responsibility – Only if in a wall cavity or similar.
European Wasps
Other Assistance – Local councils deal with eradication of European wasps. Contact the council for advice.
Birds
Landlord Responsibility – Landlord to remove and seal off entry points.
Cockroaches, Fleas and Spiders
Tenant Responsibility – For eradication during tenancy.
Landlord responsibility – Only if infestation within 30 days of tenancy commencing.
Mice and Rats
Tenant Responsibility – For eradication during tenancy.
Landlord responsibility – Landlord to take responsibility for long term prevention, including sealing off entry points.
Possums
Landlord responsibility – Landlord to remove and seal off entry points.
Snakes
Tenant responsibility – For eradication during tenancy.
Landlord responsibility – Landlord responsible if snake was present at the commencement of the tenancy or landlord’s breach is responsible (eg. piles of rubbish left in garden by the landlord).
