Correct about the stamp duty exemption only applying to principal place of residence. i.e. investment properties will attract stamp duty. However, you should still be able to avoid paying for stamp duty or capital gains tax if you put 'love and affection' under consideration for the property. Because SRO/ATO cannot apply tax to 'love and affection'. On the other hand, consideration of 'love and affection' will not help with re-financing or negative gearing as the transaction did not give rise to new/additional debt.

这要做一个full valuation report for stamp duty purpose, 比 mortgage 的valuation 贵很多,for mortgage purpose 的valuation是那种Pro- Forma(shortform)的.

Simply put down 'for love and affection' under the consideration heading. i.e. the transferor spouse did not receive any monetary consideration from the transferee spouse. He/she did it out of love and affection for her/him. This will only be acceptable for married couples or de facto partners (not sure if it includes same-sex couples, but that's probably a bit rare in the Chinese community).
Just to re-iterate, doing so only avoids the requirement to pay stamp duty on the transfer in Victoria. It will not:
1. avoid capital gains tax, (if it's not a primary place of residence)
2. avoid land tax (if it's not a PPR)
3. allow the transferee spouse to get a re-finance for the property, as they paid nothing on the transfer. Although it may still be possible to use the house as security on a separate loan.

。。。。。ato认为你按照market value把房产从一方转到另一方,ato不管你有没有现金收入。ato认为这个财产转移的过程所有者改变了。就是这么简单。
