本人是房东,就房子一直交给LJ XX (某全国大型连锁地产中介) 管理。从去年底开始,就发现他们收到租后没有及时转到我的账号上。催了无数次才在二月把钱划到我账上。当时问他们付款为啥这么慢,他们的借口是会记病了,所以一切付款有延误。然后,然后更狗血的事情发生了,三月的租金又晚了好长时间。打电话,发邮件不接(当时人在国外,不能亲自上门讨钱)。每次打总机总是线路忙。终于,上周五发现网站上所有电话DISCONNECTED,立即上网查,居然网站也没有了, 显示查无该网站。心里纳闷,立即打电话去总部,总部说, 该连锁店的负责人严重违法连锁合约,所以被总部解除连锁。至于损失的租金,她让我找CONSUMER AFFAIRS. 总部没有任何责任。
听了心里大惊,于是立马打电话去CONSUMER AFFAIR, 有个专门处理这种的部门,叫STATE AGENCY RESOLUTION TEAM. 听了几乎半个小时音乐,终于有人接待了。 她给出的建议是, 立即找新的PROPERTY AGENT接收,让租客停止向原来中介账号付款,转到新的AGENT, 还要把BOND DEPOSIT 转到新的AGENT, 要不然以后租客根本拿不到BOND DEPOSIT. 至于损失的租金,我可以尝试向VITORIAN PORPERTY FUNS 申请补偿,但不知道啥时候拿到钱,而且还要证明我的损失。
放下电话,又立即打电话找AGENT 接手这个烂摊子。终于找到一个,收费合理。更难得的是, 更难得的是, 更难得的是(重要事情说三遍),他立即帮我上门找租客,因为我居然连租客的联系方式都没有。告诉他们新的付款账号,拿BOND DEPOSIT NUMBER. 这时候悬着的心才放下。虽然损失了前两个月租金,但起码这个月不会这样了。
据说关闭的中介拥有 包括 glen Waverley, mount Waverley, Doncaster,box hill等几个分店。还有一个区忘掉名字了。 希望如果你是房东或租客是通过这5 家 中介,而且你最近房租收不到,也找不到你的AGENT, 请立即找新的AGENT 接手。
业内人士能否告诉我怎么拿回我的租金。人跑路了,找不到。总部又事不关己。好奇那些在它哪买卖房子的金额比租金多很多,他们的钱是否也象租金一样跑路了。

29 ARPIL -- 再次打电话去CONSUMER AFFAIRS, 这次的态度比上周明显不同。可能是很多人举报了。她说CONSUMER AFFAIRS正在调查这件事。已经派了一个STATUTORY APPOINTEE进场GLEN WAVERLEY 原JL 办公室处理这个事情。我问他能干点什么保护我们的权益。CONSUMER AFFAIR 说因为事件在调查中,不知道能否冻结TRUST ACCOUNT. 可能要调查结果出来后才可以。她让我打电话去那个办公室找这个政府委派的负责人。同时可以向VICTORIAN PROPERTY FUND 申报赔偿。放下电话立马把申请表填了,连同其它文件交上去。但不知等多久。
然后试着打原来的总机号码,居然神奇地接通了。上周已经DISCONNECTED 了。 一个自称VICTORIA STATE MANAGER的人接的电话,把我的资料留下,说WHEN I GET TO THE BOTTOM OF THE FILE, I WILL CONTACT YOU.
然后又打电话给保险公司,因为有买LANDLORD INSURANCE。保险公司说1) 从来没有遇到这种事。2)技术上租客没有不给钱,中介跑路了是犯罪行为,所以保险公司不一点能赔偿。

29 April - 报纸报道了,她居然对CONSUMER AFFAIR说有黑客入侵了她的TRUST ACCOUNT 把钱拿走了。记者访问总部时,总部说她原来的说辞是老公把TRUST ACCOUNT的钱挪用了。 原文如下:
Ms Truc told Fairfax Media that she had reported to head office that her internal computer systems had been hacked.
“It’s was hacker,” she said in a text message, “all my systems last year … and someone set me up with trust account.
“I report to head office and my auditor, also Consumer Affair investigate too.
“Currently I am waiting for the result. They are dealing with my lawyer. I cannot say anything now.”
Ms Truc said she “would love to see the result soon” of the investigation.
“I have no ideas [sic] what will happen next,” she said.
Consumer Affairs Victoria has taken physical possession of the six branches under the Estate Agents Act 1980.
LJ Hooker head office said the franchise offices, operated by JNT Law Investments Pty Ltd, were terminated last Thursday because of a breach of its franchise agreements.
The company also refuted Ms Truc’s (also known as Judy Nguyen) claim that her trust account was hacked.
“On 20 April, the day prior to termination of the franchise agreement, Ms Judy Nguyen informed LJ Hooker for the first time that her partner, Joseph Ngo had misused trust funds,” an LJ Hooker spokeswoman said.
“At no time did Ms Nguyen say that her trust account had been hacked.
“Prior to 20 April, LJ Hooker had not been notified that money had been wrongfully taken from the trust accounts of JNT Law Investments.”
Consumer Affairs minister Jane Garrett has appointed Garry McLean of PPB Advisory as statutory manager.
LJ Hooker head office is assisting Consumer Affairs with its investigation and identifying customers who have lost money.
Mr McLean was instructed to reconstruct records, deal with outstanding consumer and landlord or tenant transactions, and wind the business down, a Consumer Affairs statement said.
总结这次事件的经验教训:以后找中介不一定要找全国连锁,关键是那个店的老板。是否在行业立足了很长时间。像她这种半路出家的就不要找了。

我现在的中介说做了二十年,第一次听说这种事。墨尔本居然有这样的事。总部的人说这几家连锁的负责人叫Judy. 因为是连锁,每家各自经营,自负营亏。有兴趣的可以去glen Waverley Springvale road Chemistry warehouse左边二十米远的那家地产中介看看他有否在门上贴上关闭原因。
