负债5亿而倒闭的悉尼和黄金海岸房地产开发商未来集团(Ralan Group)的前雇员和公寓购买者昨日在新南威尔士州议会外抗议,要求退还他们的资金。

Scores of former employees and apartment buyers caught up in the $500 million collapse of Sydney and Gold Coast property developer Ralan Group protested outside NSW parliament yesterday, demanding their money back.

The protesters, who face losing millions of dollars in unsecured deposits on hundreds of yet-to-be-built Ralan apartments in its Arncliffe development in Sydney and its Ruby collection towers on the Gold Coast, called for investigations by the Australian Securities & Investment Commission and the NSW government. The protesters, many of whom had worked for Ralan on commission-only sales contracts for years, had invested heavily in the off-the-plan apartments.

Former Ralan sales consultant Gary Chu said he had put down an unsecured deposit of $500,000 on two apartments in the Arncliffe development, which is under construction, and the yet-to-be-built Ruby tower on the Gold Coast.

Originally from Hong Kong, Mr Chu said he had worked for Ralan, which entered voluntary administration last week, for the past decade.

“We are trying everything we have to get the money back. We try the media, legal action … and we want the voluntary administrators to check (Ralan) founder William O’Dwyer personally,” Mr Chu said.

Mr O’Dwyer did not return calls from The Australian.

Jane Wu from China’s Fujian province said she had been working on commission only for 10 years as a sales consultant for Ralan Group.

Ms Wu is angry that she lost money herself and also encouraged more than 100 of her valued clients to invest in Ralan by putting down unsecured deposits on apartments.

She had also put her superannuation into buying Ralan apartments. “All my money is gone,” she said.

The protesters said they would attend the first creditors’ meeting tomorrow, demanding the return of their unsecured loans.

One of the biggest of the 1800 individuals and businesses owed money from the collapse is Queensland builder Hutchinson.

The private builder is owed $5.5 million from the construction of the first Ruby tower on the Gold Coast, which was completed last October. Chairman Scott Hutchinson said the $5.5m represented his profit from the tower.

Another developer on the Gold Coast, speaking on condition of anonymity, believed that Ralan had spent too much money land-banking vacant Sydney sites for residential development.

“The Queensland Office of Fair Trading has recently been made aware of administrators being appointed to the Ralan developments and is in communication with the administrators,” said a spokeswoman.

“Under the Queensland Property Occupations Act (POA), the deposit received by the property developer must be paid directly to either the public trustee, a law practice or a property agent.

“The money received must then be held in trust and dealt with in accordance with laws governing that trust account.”

Under the law governing trust accounts (the Agents Financial Administration Act or AFAA) withdrawals can be made from a special trust account to cover expenses with the consent of both parties to the transaction.

“If a developer is found in breach of either POA or AFAA, the OFT will take appropriate enforcement action and this may include court prosecution,” the spokeswoman said.

Frank Higginson, a partner at Brisbane-based law firm Hynes Legal, said it was clear Ralan had not complied with Queensland property law.

Deposit monies for all contracts in Queensland for off the plan units must be paid to the trust account of a lawyer or a real estate agent. End of story. You cannot contract out of the [Queensland] Land Sales Act," he told the Financial Review.

“Developers up here are very well trained and just know you simply cannot do it any other way.”

In NSW, where some developers have amended standard contract rules to hold buyer deposits themselves, new legislation will soon come into force that places restrictions on how a deposit is held to ensure that it is protected in the event of the developer’s insolvency.

Clear rules
In Victoria the rules are clearer.

In Victoria, developers selling off-the-plan ... can only take deposits through a legal practitioner, conveyancer or licensed estate agent who must hold it in trust until the registration of the plan,” said a spokeswoman for Consumer Affairs Victoria.

总结一下,因为各州法律不同,昆州的定金是不能被挪用付利息的,所以投资黄金海岸的还可以走法律途径维权。

新州就不一样了,新法还没有生效,签了协议要回来的概率更小。

太贪婪,deposit放在trust account里面是安全的,有律协或者政府兜底,为了那点利息担那么大的风险,变成无抵押贷款,和国内私人借贷一样
