但,作为个人使用。新移民把电器设备打包运到澳洲,或者eBay 网上买回来的电子电器设备。这些不是针对澳洲市场销售的。肯定没有澳洲C tick 认证标志。这就是水货。如果从澳洲商店买的电器肯定有这个标志,你可以看下你家电水壶标签,电视后面标签。都可以看到这个标志。
问题来了。如果,没有澳洲认证的电器发生火灾,把房子烧掉了。澳洲保险公司经过调查,发现电器设备不符合澳洲标准。保险公司会赔偿吗?
还有个延伸问题。中国一些开店铺做生意的。这些老板在中国买些灯具和电器设备。然后找本地的电工安装。中国来的灯具和电器设备肯定便宜,但没有澳洲认证。电工有自己的保险,如果出现火灾,电工保险会理赔。那么业主也有保险。出现火灾也会理赔。但,如果店铺使用中国没有认证的电器设备发生火灾。哪个保险理赔呢?
我这里说的是个人使用的电器设备。不是在澳洲销售电器设备。

• pollution or vapour from a home heater or a cooking appliance unless a fire spreads from the initial source.

刚在澳洲边境保护看到说明,网上购物有要求,气和电产品如果不符合澳洲法律要求,不要进口,属于警告。但还有人进口这些产品。能带进来的产品不代表就是合法产品,因为真管不过来。我在电视上看到,手机充电器,很多店铺买中国生产的手机充电器,不符合澳洲安全标准,执法部门在清缴。会给客户带来隐患。所以说,不是在澳洲存在的就是合法的。一旦出现事故就有人做调查看是谁的责任。不出事都开心。

真有。比如中国新移民。把手机充电器,电饭煲,还有油烟机,电吹风,路由器,笔记本,还有海外来的学生,他们携带大量的电子产品。还有的中国老板,在中国进口来的灯具,灯。安装在新的店铺里。我自己亲眼看到的。但我一直有个疑问。澳洲法律是严格,但肯定有个规定豁免移民和学生搬家带来的电子产品。我就是找不到具体证据来说明。

Sale of level 1 in-scope electrical equipment by responsible supplier
(1) A responsible supplier of a type of level 1 in-scope electrical equipment must not sell an item of the type unless—
(a) the responsible supplier is a registered responsible supplier; and
(b) the item meets the relevant standard for the type as in force—
(i) if the responsible supplier is a manufacturer of the type—at the time the item was manufactured by the responsible supplier; or
(ii) if the responsible supplier is an importer of the type—at the time the item was imported by the responsible supplier; and
(c) the item is electrically safe.
Maximum penalty—40 penalty units.
(2) It is a defence for the responsible supplier to prove that the responsible supplier obtained the item from a registered
responsible supplier.
Example for subsection (2)—
This example assumes New Zealand is a participating jurisdiction. A New Zealand responsible supplier (company A) is a registered responsible supplier. Company A imports level 1 in-scope electrical equipment into New Zealand from the United Kingdom. Company B is an Australian company that purchases the level 1 in-scope electrical equipment from company A and imports it into Australia. Company B, although a responsible supplier, is not a registered responsible supplier.
If company B were charged with an offence against subsection (1) in relation to its sale of an item of the equipment, it would be a defence for company B to prove that it obtained the item from company A who is a registered responsible supplier.

你这里再说供应商,这个属于商业范畴。意思是说定义一下供货商,制造商,进口商的责任。这也是正规渠道。我的话题在说“私自进口”,没有法规保护的电子产品。已经脱离了正常法律规定的范围。但如果私自进口的电子产品产生火灾,保险公司肯定要按照澳洲法律来执行。
记得masters在昆州销售电线,来自中国。后来发现电线不符合澳洲标准,缺少一种添加剂。在高温环境下电线绝缘老化,产生火灾。所有使用这个牌子的电线都要换掉。估算更换费用要耗资1亿澳元。电线供货商是华人,有公司。而这个公司负责人已经在法律程序中。

The ACCC has warned Australian consumers about the potential dangers of purchasing products online, saying that while mandatory standards apply to products sold in Australia, those same safety standards do not necessarily apply to products sourced from overseas.
The deputy chair of the ACCC, Delia Rickard, took the opportunity to speak about the issue during International Product Safety week, which is running this week, saying that many consumers face issues when purchasing products from overseas websites.
“Mandatory standards and bans apply to some products sold in Australia,” she said. “Even though products sold here are legally required to meet these requirements, people may be able to purchase products online which don’t meet these standards or have been recalled in another country.”

The issue is particularly relevant in the consumer electronics and appliance industry, with the rising popularity of online shopping and grey market product sourcing leading to more consumers purchasing electrical goods through online channels, including websites based overseas.
Rickard highlighted that the ACCC maintains a Product Safety website designed to offer consumers “the information they need to determine if their purchase meets Australian standards,” and to assist in making informed online purchasing decisions.
In addition to this, the consumer watchdog has also launched a new global recall website, following consultation with a working party set up by the Organisation for Economic Co-operation and Development. The site, which is also hosted by the OECD, was spurred on by the need to coordinate product recall information in an increasingly globalised marketplace.
“This portal has been designed to help consumers, business and government to keep up to date with product recalls in different countries,” said Rickard. “Australia, the United States, Canada and the European Union are current contributors to GlobalRecalls but we are encouraging as many countries as possible to join.”
The website allows consumers and businesses, including retailers, to search for products by product name, country of manufacture and date of recall.
For example, a quick search for ‘cameras’ brought up a range of products, including products from well known brands such as Canon and Nikon, which have been sold in the US but could have easily been ordered from consumers in Australia.

我记得一个朋友建房的时候, 自己Ebay买了个整体浴缸,没有澳洲认证,builder不给他安装。
验收入住后才自己安上去的。

上边写了,不符合要求得:Maximum penalty—40 penalty units.
这个units就不知道多少钱了。
infinity cable就是一个例子,进口商要买保险,但是她进口的电线是不符合澳洲要求的电线,所以保险不赔,那就要打官司要她自己赔。
现在的要求是,contractor要把这些电线全部拆下来 (免费的),送回wholesale那边,批发商要免费更换电线给contractor,但是批发商以后我就不知道了。
所以千万不能图便宜,买一些没听过牌子的东西,死都不知道怎么死的。
