From 1 November 2012 an unrestricted licence holder can only use a mobile phone to make or receive a phone call while driving if the phone:
- is secured in a cradle fixed to the vehicle, or
- can be operated by the driver without touching any part of the phone – e.g. through the use of hands free or Bluetooth technology
You cannot hold a phone in your hand, other than to pass it to a passenger, and cannot rest the phone on your leg or between your shoulder and ear.
Under rule 300(2) of the Road Rules 2014 (click here for the Rule), the body of a mobile phone is secured in a mounting affixed to the vehicle only if:
a) The mounting is commercially designed and manufactured for that purpose, and
b) The mobile phone is secured in the mounting which is affixed to the vehicle in the manner intended by the manufacturer.
Therefore, the mobile phone cradle/mounting must be affixed in accordance with the manufacturer's instructions.
The mounting of the phone must not obscure the driver's view of the road. The phone must be fixed securely, must not be fitted to the head-strike zone and must not interfere with any safety device such as an airbag.
Please note that Learner and P1 drivers and riders are not permitted to use a mobile phone at all while driving or riding.

Having an autopilot function on the vehicle does not give the driver exemptions from the law. You must obey these laws or heavy penalties will apply and the risk to others will be higher.
As mobile phones are not permitted to be used whilst driving as stated above, neither would watching a movie or reading a book.
