一名计算机学生在收到集体诉讼案的20刀赔偿后,恼怒的写了一篇文章发泄对体制的不满。

他质疑车厂是不是只要加价一点就可以把钱赚回来了。

然后他控诉为什么体制允许律师们做了那么一点点事,却获得了那么多的利润,而真正的车主们只能分到可怜的一点钱。

具体的赔偿数目和律师费用在文章里有。

还有一段文字描述了律师回应说为车主们争取到了那么一点点赔偿而“自豪”。

(这里我要补充一下,至今没有任何证据可以证明丰田车在没有外物干扰的情况下存在加速失控的问题。丰田赔偿的目的是与集体诉讼另一方和解,并没有承认存在加速失控问题。显然一群律师忽悠了一大群车主去诉讼,然后给了车主们一点零钱就把他们打发走了。)

Jonathan Sourbeer, a computer science student in Redmond, Wash., says he recently got a check in the mail for $20.91. As a Toyota customer, the money was his share of the $1.1 billion that Toyota Motor Corp. agreed to pay in 2012 to settle a class-action lawsuit stemming from complaints of unintended acceleration in its vehicles.
The check was one of millions distributed to millions of Toyota, Lexus and Scion owners who qualified as class members and were eligible to receive cash payments as compensation for economic losses due to problems with the vehicles.
Mr. Sourbeer, in an op-ed in Monday’s Wall Street Journal, is less than appreciative. He compares the amount he got against the $227 million in fees and costs distributed to the roughly 85 plaintiffs lawyers who worked the case.


Mr. Sourbeer says he doesn’t begrudge the money awarded to the lawyers, but says his $20.91 check got him thinking about the ultimate winners and losers of the litigation. He writes:
I got angry because of the economic loss caused by this lawsuit in the years following the settlement. For me to get that $20.91 check is costing Toyota more than half a billion dollars in litigation, fees and the settlement awards.
How much will that cost me in the future? Will it add $200 to the price of my next car? Or $500? Or $1,000? Maybe that’s too much of an add-on in this case. But is it too much when we start totaling the lawsuits that hit all the products we buy every year? Why do we have so much litigation, and why are courts (and the juries of our peers), awarding so much money in situations when lawyers have produced so little, comparatively, for their clients?
Plaintiffs’ lawyers hailed the Toyota agreement as a consumer victory when the deal was announced in December 2012.
“After two years of intense work, including deposing hundreds of engineers, pouring over thousands of documents and examining millions of lines of software code, we are pleased that Toyota has agreed to a settlement that was both extraordinarily hard-fought and is exceptionally far-reaching,” Steve Berman, a partner at Hagens Berman Sobol Shapiro LLP in Seattle, said at the time.
The size of the Toyota settlement checks “varied greatly,” said Christopher O’Hara, a Hagens Berman partner who was among the attorneys who worked on the settlement. Class members who filed eligible claims received checks ranging from $125 to $5,977, he told Law Blog by email on Monday. He said Mr. Sourbeer’s checked represents his pro rata share of unclaimed money. “We are very proud of the excellent results obtained for the Class through this settlement,” he said.
A spokesman for Toyota declined comment. “One of our overriding goals has been to vigorously defend the safety of our vehicles, and we believe we have done that,” Mike Michels, a Toyota spokesman, said in 2012 after the deal was announced.
Mr. Sourbeer, meanwhile, says his $20.91 Economic Loss Settlement check still sits on his desk uncashed.

个人对美国社会第一手的体会只有旅游那点经历。就旅客的角度来说,美国商家确实比澳洲日本欧洲商家更加赤裸裸的纯粹追逐利润,可能是当地文化的一部分。换了一个别的地方,我觉得律师不敢那么高调的给自己贴金,因为事实很明显。
