新西兰急:关于房屋交割
在新西兰
买房后天交割, 卖家买了另外一个房也是当天交割。而且卖家要后天下午才能搬空,代理说4PM左右,卖家要当天搬到新买的房。所以我要做最后检查只能明是天了,而且屋主东西都在里面,不是空房。明天检查后,后天也没有权利再看了,只能祈祷屋主搬家过程不会有什么破坏和东西都留下了。
大家有什么建议可以保护我买家的利益呢?

最好交割日检查。不过,我当时的房子就是提前检查的。充分相信对方 。后来想想还是有风险的。

律师说了法律规定必须提前1天检查,没有要求必须是空房检查。所以明天必须检查。
延期交割是不可能的,如果后天不交割,要算我违约。哎。。。 买了自住房,似乎只有自己承担风险了。

卖房中介告诉我对方要后天等到钱到帐才开始装车搬家,即使我后天一早律师给对方付钱也可能要等到下午很晚才能拿到钥匙。

一般都应该是4点以后拿钥匙吧,房屋有问题不会影响交割的,除非是不能够居住的问题,其他问题保留证据,可以打官司。

让你律师明确通知对方律师此事,记住一切要按合同办事,如果合同被违反了,就通知对方将按照合同规定的违反时的情况去处理,这样对方律师就会给对方施加压力,比你说有用多了。然后保留证据,以便以后需要时用的上

卖家最后一刻交房和钥匙没违约啊,只是我自己不能等他搬空检查了.

not an ideal situation, but the best you can do.
i faced the same problem, the purchaser received the money at 12:00noon, but only finished moving house on 6pm. Agents gave me part of the keys at 1pm, but the "previous owners" still at the house moving, he just said a few more hours, please.
My take it, don't stress out, just be happy on this occasion.

If you ask a lawyer about leaky home ? the lawyer will say get a builder to check.
if you ask about the illegal renovation? the lawyer will say check with the council, builder/ professional inspector.
if you ask a lawyer about chattels that are not working ? the lawyer will say if they are not working at the time you signed the agreement, you can't claim against the owner, it is written in the agreement.
If you ask lawyer there are rubbish the vendor still left in the house? The lawyer will say, I will let vendor lawyer know, if he doesn't remove it, you can claim in disputes tribunal (for removal costs).
To cut it short, the conveyancing lawyer you engage is dealing with the transaction. Any disputes, the lawyer will just tell you what agreement said and they will not solve the problems for you. You will have to find the solutions yourself. A lot of people mistaken the fee ( $900- $1200) that you paid is for a lawyer to solve the disputes for you, the answer is " BIG NO", it is not the way it works in NZ.
Any matter involving disputes, you will have to engage a different lawyer that deal with disputes, and you will have to sign a proper engagement letter with a separate set of fees structure.
You can only hope you buy a "good house with minimal issues", and don't expect conveyancing lawyer to deal with issues for you. they will tell you, your agreement is unconditional, you will have to settle, if not you will face a penalty or even get sued etc. You settle the purchase, as it is in the Agreement, you still reserve the right to sue the seller, which is a totally different matter.
