去cc的家长们都知道,在cc只能給自己的小孩照相,因为privacy的问题。这个容易配合,也很愿意配合。
但是,去到游泳池学游泳也不給照相和录像,这个比较郁闷,想給爷爷奶奶外公外婆看看都没机会了。之前去ikea的室内playground,在ball pit里面玩,也被告知不能照相。其实,在公共场所,我们照的也是自己的孩子,谁想把别的孩子照来。
谁能告诉我privacy law的哪条有这样的规定了?

真是这样吗? 澳洲事儿真多。
只知道不可以随便扛着脚架拍摄建筑物, 出于什么公共安全的考虑。。。可是 playground也不给拍孩子,有点那个吧!

是呀,我就觉得不爽。谁有兴趣去拍别人,有闲杂人等的我还嫌碍眼呢。

我不是律师,但是我来说说自己的看法。
以我的理解,拍自己孩子应该是可以的。但是照片里面有其他孩子可能就有问题了。
现在的最大问题是恋童癖的问题被放得太大。造成商场等等地方的管理部门担心有可能成为被告,所以就用最简单最粗暴的办法来解决:一律不许拍照。但是如果你真的拍了,估计法律上他们告不到你,但是可以禁止你进入他们的地盘(因为你不遵守商场的规矩)。

稍微看了一下www.privacy.gov.au,感觉the Privacy Act是针对busienss和individual之间的,比如某个organisation怎么处理你的照片。对于我说的这种情形,是individual和individual之间的,貌似无规定。如果别人未经你允许拍你照片,政府的建议是让你报警
Photos and surveillance
There are Commonwealth, State and Territory laws that relate to taking and using images of a person without their permission, or recording their conversations or movements. Which law applies will depend on the circumstances, in particular:
•where the surveillance occurred or the photos were taken
•what was being monitored or photographed
•who was responsible for the surveillance or images.
The Privacy Act does not cover individuals acting in a personal capacity, such as a neighbour taking photos of you.
Someone has taken photos of me without my permission. What can I do?
Consider contacting the police. The Privacy Act is unlikely to apply in this circumstance as it does not cover individuals acting in a personal capacity.
My photo has been posted online without my permission. How can I get it removed?
The first step is to ask the person who posted the photo to the site to take it down. If the person refuses, or you don't know who it is, you may wish to contact the administrator of the site and ask them to remove the image.
If the photo was posted online by an agency or organisation, or the site is hosted by an agency or organisation that is covered by the Privacy Act, you may be able to complain to our Office.

一般的playgroud还是可以照相的吧?Ikea的playground是商场内部的,确实可能是因为不想惹麻烦所以限制拍照。其实有时去看商场的Show,也会被告知不能拍照录影,可能也是同样原因吧,毕竟公共场合,即使我们都不愿意拍到自己孩子以外的人,不过很多时候确实很难控制别人不窜进我们的镜头的。

一般的公共场所都有自己的privacy protection policy,只是很少有人去看,而儿童的privacy则更受父母关注,你也不希望哪天上网突然看到自己孩子的照片出现在某个网站上吧!
只能说你拍可以,只是如果一旦有人追究,那就不好办啦!

我学校里面,学生来参加活动,都要家长签好几张批准的东西,批准来参加,批准照相,批准我们使用相片,批准我们使用录像,批准我们把相片录像发在有密码控制的learning support system上。。。

估计是孩子离的太近孩子比较多,在不同的游泳池给孩子拍过照片,录像的人飘过
这个事情估计是可大可小的事情,孩子集中在一起,商场为了避免麻烦所以才出此规定吧

In Australia, there is currently no legal rights that protects an individual’s from been photographed. Therefore, a person in the Australian society does not have a right to privacy and can be photographed without consent. The right to take photographs does not contravene any case law or statues and also does not constitute an invasion of personal privacy. However, Common law doctrines such as nuisance, trespassing, defamation, offensive behavior, and infringement of rights can still apply and impose onus of proof on the photographer.

大部分的公共泳池都不允许照相。这个挺好理解,大家都穿得比较少,拍照比较尴尬。上面说说随便照的,我觉得没人管,不代表可以吧。

我爸曾经在小学门口乱照相 老师报警了 警察说只要是照片上有其他人都不行 特别是未成年人! 我说,这难道不是公共场所吗?警察说,也不行,不服气我们就遣返你爸!。。。

在路上是可以的,但是进去不行。如果在路上可以把相关条文翻出来。
但是就是当时的情况,不适合和警察正面冲突,警察也没有权利在路上检查你的设备。

Police Officers in Australia are generally friendly and do not mind their photos taken. However, when Police Officers are duty to conduct a mission then any intervention/interference to their duty should be prevented thus do not take Photos when officers are carrying out their duties.
When there is unnecessary physical conduct by the police that is unacceptable and/or unreasonable, there is always an option to file a complaint to the NSW Police Commission. Before a photographer files a complaint to the Police Commission, it is suggested to get all the details of the Police Officer/s that you are going to make a complaint along with plenty of evidence for the assault. For example, the identification number and full name from the Police Officer/s along with photos/videos/sounds recorded at the scene.

In the case that Photographers is approached by the Police and the Police may ask for personal identification. However, in NSW that Photographer does not have to comply with this request excepted in the case of:
where you are in lawful custody, or the police suspect on reasonable grounds that you may assist in the investigation of an indictable offence (Law Enforcement (Powers and Responsibilities) Act 2002 (NSW))

每个游泳池都有自己privacy规定问清楚。我们的是需要申请一个牌子戴上就可以拍照否则不可以。问一下前台。

在泳池前台和她们说一声,要给孩子拍照拍录像,她们会让你登记一下,然后给你一个sticker贴身上,证明你是被允许拍摄的。但是尽量镜头里只照自家的娃。

老外很在意这些,有一次在商场有年轻女孩直接叫保安的,说一中国老头拍她
在国内一直拍拍拍的,来了这里发现别人家长不拍的,什么学校活动,出门游玩,生日会也就拍个集体
