We advise that we act on behalf of Mr. Raz who wishes to make this application to waive the 8503 condition attached to his Visitor Class FA, subclass 600 visa in the Tourist stream.
Background
There is an active outbreak of a novel (new) coronavirus (2019-nCoV) in China, originating from Wuhan City in Hubei Province.
Application
Section 41(2A) of the Migration Act 1958 provides that the 8503 condition can be waived under prescribed circumstances. We submit that in accordance with Regulation 2.05(4) of the Migration Regulations 1994, for the following reasons that since Mr. Raz’s visa was granted there were compelling and compassionate circumstances developed over which he had no control and that resulted in a major change to his circumstances:
For subsection 41(2A) of the Act, the circumstances in which the Minister may waive a condition of a kind described in paragraph 41(2)(a) of the Act are that:
(a) since the person was granted the visa that was subject to the condition, compelling and compassionate circumstances have developed:
(i) over which the person had no control; and
(ii) that resulted in a major change to the person’s circumstances; and
(b) if the Minister has previously refused to waive the condition, the Minister is satisfied that the circumstances mentioned in paragraph (a) are substantially different from those considered previously; and
(c) if the person asks the Minister to waive the condition, the request is in writing.
It is submitted that the outbreak of 2019-nCoV represents a major change in circumstances. Before Mr. Raz was granted the tourist visa, there is no finding or reporting of such a coronavirus. Also, the Chinese government has announced Wuhan City has been put in lockdown to contain the spread of the novel coronavirus.
It is also submitted that the change in circumstances was beyond the control of Mr. Raz. It is obvious that the outbreak of the coronavirus and the city lockdown was beyond his control.
Lastly, it is submitted that the changes in circumstances that have arisen represent compelling and compassionate circumstances.
According to the Department of Health, there is no specific antiviral treatment recommended for 2019-nCoV infection (https://www.health.gov.au/health-topics/novel-coronavirus). We are very concerned if Mr. Raz returns to Wuhan at the moment.
It is reported that the virus has so far killed more than # people, with nearly ## confirmed cases in Mr. Raz’s local area in Wuhan (evidence needs to be attached). The nearest hospital, ###, is out of its capacity and cannot handle any more cases. As Mr. Raz has spent the previous months in Australia and he does not have any contact locally, he would be very difficult to gather daily necessitates to support himself.
Thus, the current local emergency situation gives rise to Mr. Raz’s compelling and compassionate circumstances, which satisfies the requirements for a waiver under regulation 2.05(4).
Request
In view of Mr. Raz’s particular circumstances, it is of enormous benefits for him to remain in Australia for the sake of his health and safety. We request that the 8503 No Further Stay Condition attached to his visitor visa be waived so that he may make a valid application for a visa onshore.
