The 103 and 804 subclasses are permanently closed to new applications (repealed) on Monday 2 June 2014. Applications not received before 2nd June 2014 will not be valid and will be returned.



The Budget papers released on 13 May 2014 advised that new applications would be ceased under the Non-contributory Parent category (including subclasses 103 and 804) and the Other Family category (subclasses 114 and 838 (Aged Dependent Relative), subclasses 115 and 835 (Remaining Relative) and subclasses 116 and 836 (Carer)).



All applications made prior to the change will continue to be queued and processed in accordance with existing legislation, policy and Processing Direction.

As we are currently receiving extremely high numbers of applications due to the Budget announcement please do not ask for confirmation that we have received your application. If it was sent registered mail, express mail or by courier you will have tracking details to use to confirm that the package has been delivered and on which date it was received. We appreciate that applicants will be very anxious to confirm the validity of their application, however the volume of mail is such that it is not possible to check for every enquirier.

All valid applications will be receipted in due course and a receipt sent by email. All invalid applications will be returned. Due to the high volume of mail it may be up to a month before you hear from us. We will endeavour to contact you as soon as we can.

又打了一个电话,质问了一下为啥昨天有人打电话就说接受呢,他们很肯定的告诉我说2号之后收到的申请全部无效,她还去confirm了一下,我说那我们周五邮寄的没可能你2号能收到啊,她说就是这样规定的。。。。。

早晨打电话给parent visa centre,问了下周末递交的是否算valid申请,她直接说maybe not,我说why,他说现在正在处理和返还大量的申请,现在还无法确定结果,要等等看,如果扣款了,应该就算接受了。

以下是移民局给的投诉回复,毫无意外,基本上模棱两可,蓝字部分是重点,其他的都是官腔。

Thank you for your feedback to the Department of Immigration and Border Protection’s Global Feedback Unit on 31 May 2014, Reference Number: regarding the cessation of the Non-contributory Parent and Other Family visas on 2 June 2014.



The Australian Government announced its intention to close the Non-contributory Parent and Other Family visas in the Budget papers on 13 May – almost three weeks before their repeal on 2 June 2014.  Following the budget announcement, the department’s website and advice to clients and stakeholders indicated the visas would be closed to new applications before the beginning of the 2014-15 Migration Programme year.



The department has instigated an administrative process to ensure that there is consistent treatment of all Parent, Aged Parent and Other Family visa applications received by the department in the days leading up to, and following, the repeal date of 2 June 2014.  This includes allowance for all avenues that an application may be delivered to an Australian office of Immigration, or to an offshore office or Service Delivery Partner.  Please note that if you have submitted a visa application for the repealed subclasses, you will be advised by the department whether your application can be accepted.



More advanced notice is not usually provided prior to changes or repeals of visa subclasses in order to avoid a last minute flood of applications which would push out waiting times even further.  With currently over 36 000 parent and 7 600 other family visa applications awaiting finalisation, this existing pipeline will enable their planning levels to be delivered for some years into the future.  These will continue to be queued and processed in accordance with existing legislation, policy and processing direction.



The Government recognises that the cessation of these visas will be disappointing to many people.  However, the programme had become unsustainable, with applications outstripping available places, creating decades-long queues.  Based on current applications on hand, the waiting time for a non-contributory parent visa is approximately 13 years, 4 years for carers, and 16 years for aged dependent relatives and remaining relatives.  The unfortunate reality was that a parent visa applied for in May 2014, would not have resulted in a person being able to come to Australia on that visa until mid-2027 at the earliest.



The ceased visa classes were ultimately unsustainable in that they had a significantly negative effect on the Budget, as opposed to skilled migration which has a strongly positive effect on the budget.



Parents of an Australian citizen or permanent resident can still apply to migrate to Australia under the contributory parent visa programme which remains unchanged.  These visas require applicants to make a substantially higher financial contribution towards their future health, welfare and other costs in Australia and can be granted within 12 to 24 months.  Application costs can be staggered by first applying for a temporary contributory parent visa and then the permanent visa after two years.  There are also flexible visitor visa arrangements for parent visa applicants so that they can visit family in Australia for periods of up to 12 months at a time.  For many families, this provides greater flexibility without the need for parents to wait for years in a queue for a permanent visa.



Ultimately, the migration programme must strike the right balance between sustainable family reunion and maximising Australia’s longer term economic growth and prosperity.  The family programme will re-focus on the entry on immediate family members – partners and children – and on parents who are able to make a financial contribution to Australia.

楼下好心的坛友打电话到移民局说3号早晨收到的申请会被接受!!!!!可能我们的投诉还是被听到了!!!继续强烈呼吁没有投诉的同志,继续投诉,保证可能的胜利果实,直到大家得到正式的lodge通知!!!!!!

移民局下午回了email给我说已经把问题转到相关部门,会在10个工作日内回复。虽然不知道是否会有成效,但至少他们的回应还算快,现在就等最后结果了。呼吁大家继续投诉移民局,这样的为所欲为的行为是不可接受的。政策可以改,但是这样的突然袭击的做法实在不是一个民主发达国家应当做出的行为。

Dear officer,

The WA Parent visa centre has secretly decided the closing date for accepting new applications without given any proper notice in advance. This way of working is extremely against the service standard of the immi department and ignore the basic right of the applicants who were working so hard to prepare for this applications before the deadline.
According to  basic idea of the Australian law, the accountable government decision making should be open, transparent and protects basic rights. The applicants especially who mailed their applications on the last weekend (30/5/2014-1/6/2014)has been given no chance to know their applications might be invalid, as there were no official notice from the immi department.Even after the news spread out in late Friday afternoon through the unofficial source, the call centre for the parents centre, who should be updated with the news, still didn't confirm any exact date to the desperate callers and ask the applicants to follow the news on the official website. This also misled the applicants to keep lodging their applications without knowing it will be invalid. The WA Parent visa centre in Perth only accept the applications through the courtier and they have sound knowledge that 2/6/2014 is the public holiday in Perth, so all the poor applicants especially who mailed their applications on weekend were played by them and all the efforts they made has been ruined, which would never be expected by any person, due to the governments irresponsible way of working.

I strongly suggest the WA parent centre to reconsider the valid date for the lodgement to be the time which applicants mailed their applications rather than the time they received them, as when they enjoyed the long weekend, the applicants were left in dark unfairly due to the irresponsible way of working.

再更新,移民局又update了新的消息,语气有一定的松动!强烈呼吁大家继续投诉,尤其周五周六的邮寄的同志,揪住他们突然袭击,而且只有perth邮寄才能lodge,所以只有按邮戳算才算公平!!!!

更新一下,我又阅读了移民局的service standard和value,可以看出他们这样做完全是违反他们的承诺的,我已经去移民局网站上submit了投诉信,有遭遇不公平的同学一起去写吧!尤其是周五寄出的,和已经花了时间和金钱准备的差不多的。
我主要写了以下几点,供大家参考:
1.私下决定重大政策改革日期,没有任何正规public notice,没有合理的transition time
2.在消息传出后,call centre在应该已经知道时间的情况下,没有给出任何合理信息,让applicant take chances,是不负责任的行为,让申请者损失时间和金钱,作为政府机构应该对他们的行为负责任。
3. 申请者没有得到应有的尊重,侵害了申请者对重大改革的知情权,由于政府草率的随便决定停止日期,使得申请者花费时间和精力准备的申请付诸东流。尤其是很多周五寄出的申请者,在不知情的情况下就可能被毫无reasonable理由下退回申请。
4.wa 只在auto reply的email里面在周五晚些时候才confirm了这个重大改革,这种形式的小范围通知的无法接受的,因为不是每个人都天天在给移民局写email。

从一个正常人的角度分析,他们这样的做法,作为一个正规的政府机构是非常不道德的,就算是法律也是本着公平的原则,移民局这样做是否侵犯了作为申请者的知情权,计较起来,所有在投递的人,都是由于他们的行为遭到了不同程度的经济和时间还有精神上的损失。就算是预算案,提出也要经过审核才能最后决定,基本上所有政策都应该给人以缓冲时间,不能私下自己决定,自己执行吧。

刚从澳洲政府的网站上查到关于澳大利亚legal system的一个介绍,如果对照他们的行为,他们完全违背了澳大利亚法律体系的fundamental belief

移民局这样做,先例很多,至少在技术移民的变更上,过去好多年都是这样发布消息立即实行的,不过大多会事先吹吹风,透露一下可能会有的改动。但是一旦改动了,就立即实行。

这次移民局也照例吹风了,

5月15日预算案提出了会终止103申请。

5月15日移民局给MIA发消息,明确了会在7月1日前就停止申请,且停止申请的日期是very near future,要求大家immediately递交申请。

5月22日在移民局自己的官网首次发布了消息,明确了7月1日前就会停止申请。

但是至今移民局还没在自己的官网发消息,从法律上没问题,毕竟6月2日还没到,且以前移民局也是法律变更当天才在官网上发消息的。但是从情理上,的确是不厚道。

给些记忆中的例子

2005年11月1日,移民局在官网上悄悄宣布,留学生申请技术移民,必须考雅思,而不再直接认定留学2年等同雅思4个6。由于悄悄宣布,很多人过了几天才知道,然后造成大家一下子都去报名雅思。雅思名额一下子排到了2006年5月份,但是很多人的学生签证是206年3月底就过期了。

2006年-2007年的某次,宣布暂时中止受理境外的技术移民申请,宣布当天就实行。就是说当天寄到的境外的申请,一律退回。

2006-2007年的某次,官网悄悄对留学生的学位和提名职业的要求进行修改。

2008-2009的某次,官网在圣诞节对于tafe留学生的技术评估进行颠覆性修改,且事先没有吹风。可想而知,圣诞节都没人的。

或者呼吁出台新种签证,至少能覆盖到只有唯一子女在澳洲的父母?

移民局已经在5月22日宣布将会停止受理103新申请,移民局可以说自己是进行了事先1个星期的告知。

我觉得,可以商榷的是,在6月2日0点前寄出的申请,在6月2日抵达移民局后,是不是应该被退回。

严格意义上申请移民的不算上文里的the public。澳洲governmnet无需向全世界负责。

ls说的确实是一个问题,作为主申请人来说确实不是澳洲的public,但所有父母移民符合条件的都是后面有作为澳洲public成员的子女作为支撑的,如果没有,也就不存在申请这个的需要,也就是说这个政策还是针对的澳洲public的需要,为澳洲public服务的。

而且又引发出我的一个考量,如果一个政府部门可以这样随便做出不负责任的政策修改的行政行为,那么是不是以后其他的部门也可以仿照先例,对自己不合理的行政行为不负责任

十分理解,但觉得根本不用投诉了,没有用,况且早就吹风了,只是有人认为七月才开始实施而已,为什么不早点投进去呢,我知道有些人赶早不赶晚已经投进去了,只能怪自己

唉,也是实属无奈,婆婆在消息出来时候刚好出差两周,公公又在外地,没法办公证,我这东西早准备好了,急的直跳脚,好容易弄好了,就差这一两天,公证件现在在post,周一送,这都其次了

关键这个政府不带这么办事的,那以后他们想干啥就干啥了
