新西兰第三方损坏了投资房,房客需要负责吗?

事情是这样的,房子的墙被撞坏了,房客说不知道是谁撞的,他们的车上也没有痕迹。和保险公司索赔,保险公司要我交垫底费,请问这种情况垫底费能让房客出或者出一部分吗?我看了看合约也就是那种标准的那种,上面好像没有写这种情况让房客出钱啊,难道只能认倒霉?

其实很有可能就是他们的车,别人的车不会停在那里,但是估计是修好了再通知我的,我也没有证据。

如果找不到证据损坏是房客或他的客人造成的, 只能自己付垫底费了

unfortunately if it wasnt caused by the tenant, and you dont have any evidence to show to that they did so, or another 3rd party did so, then you may have to fix it yourself. Unless the tenant was the witness and called the police to get a police report.

地震是不属于可预见的范畴,房客没有看好房子,把房子撞坏了,难道要自己出钱吗?
好比你去租个车,然后停在停车场被撞了没找到人,回来你是不是要给租车公司垫底费,但是如果找到人了,就是那个人的责任了,你就不要付垫底费,但是如果是地震,你觉得他会让你付垫底费吗

hmm, it depends on the structure for the property. For example: the property is fully fenced, and the exterior wall is damaged by force. Then you may try to claim that from the tenant. But if the house is sharing the driveway or not fenced, and clearly the wall is damaged facing to the sharing driveway, then you cant charge to the tenant for sure.

You cant just take that from the bond, if the tenant doesnt agree to that, they can bring that to tribunal and claim more than the money you take from the bond. The bond amount to be refunded has to be approved by both sides and signed to the bond centre. If any side doesnt agree to the amount, then the owner/ tenant should bring that to tribunal to let the judicator to make the final decision.
