他什么时候搬走不重要, 重要的是你们约定哪一天end tenancy的. 你说房客是从上周不交房租的, 这周房子卖了, 那他只欠你2周房租, 3周的押金能够cover了. 如果找不到房客人了, 你可以自己在bond refund form上签字要求DBH从押金中把欠款refund给你.

再看了下你的帖子发现我之前理解错了. 我之前以为房客已经搬走了, 但现在看来情况是你的房子卖了但还没settle, 你也不知道房客什么时候能搬走?
如果是的话, 请马上看下你的卖房合同上是vacant possession 还是 subject to existing tenancies?

你既然已经给了42天notice那应该知道tenancy哪天终止了. 权衡比较, 如果担心逼得太紧他会破坏房子影响你交割的话那你就等他走了再告吧.
另外如果最近1个月没做过inspection, 你马上通知他做一次, 书面记录签字+拍照.
