Springpark buyers get $7.3m refund
Receivers of the Springpark housing development in Auckland will refund deposits of $7.28 million to homebuyers before Christmas.
Development company Panama Road Developments, 80% owned by Tony Gapes of Redwood Group, went bust on December 4 after it could not pay debt due to Asian financier Olympus Capital.
In a letter sent to 142 homebuyers this week, receivers Richard Simpson and David Ruscoe of Grant Thornton said they had concluded Panama Road Developments is unable to build the house properties.
“This is a very unfortunate situation and we understand that this may be a disappointment to the purchasers. Following a thorough review, we have determined that it is not viable to complete the project as planned as increased costs mean that Panama Road Developments Limited does not have sufficient funds available to it to finish the work.”
The deposits are held in a trust account at law firm Russell McVeagh.
Mr Gapes told NBR the project to build 424 houses and apartments on a 10.4ha site near Mt Wellington had suffered significant delays and extra costs, partly from dealing with landfill and contamination at the former quarry.
About $1.5m of extra costs was attributed to removing contamination such as heavy metals and asbestos, he said.
“It’s not until you start digging that you find this stuff.”
A 14-week delay was also caused by a design flaw in the sewer system, which required a redesign and a new resource consent before it could be constructed, he said.
The resource consent granted by Auckland Council in 2013 makes clear the land was previously a quarry filled in with “non-engineered fill”, or general rubbish.
“The site is identified on Council records as being subject to potentially weak/filled ground,” and “the site is known to be contaminated,” it said.
