这事折腾的耗时四个多月真是旷日持久. 情况如下
我去年圣诞的时候在ebay卖了个ipod touch给一个只有4点信用度的买家C. 丫当天付了钱就人间蒸发了.我看到他ebay 和paypal留的地址不一样,就发信让他核实地址,可是两天没回音. 我就把东西寄了,结果是地址果真错,东西回来了. 从去年底至今期间我前后发了不下10封信要和丫取得联系商量解决问题.这丫倒是不急四个月来差不多隔一个月回我一次.先是说度假去了,ebay地址忘改了,让我重新邮.我说我要么退款要么你得补邮费. 于是又一个月后丫说退款. 各位看官注意,这点破事前后就是3月. 钱他让我退我当天就退了. 可是又过了一周我发现退款没成功,被paypal remove了,也不知道什么原因. 到了这个地步我承认我是觉得已经做得够意思了, 倒有点真希望丫不要这钱算了,反正他不来找我我是再不管了.
又过了一个多月,突然收到丫一封邮件,从另一个邮箱发的,全文如下
Hi Dexter,
I have just managed to locate your actual email address since your ebay email address is no longer active.
The previously requested refund for Apple iPod touch (8 GB) 2010 Model AU Warrenty #xxxxxxxx has still not been received.
Previous requests sent via your ebay account have bounced back with ebay advising us that your email address is no longer active.
I found this address hidden amongst some foriegn language text in an email you sent to [email protected] on 15/12/2010 requesting confirmation of a delivery address and advising us that the item would not be posted until you received our reply.
As this message was never responded to I have to wonder why the item was ever posted to the incorrect address.
I am the owner of the credit card from which you were paid and I have forwarded your previous correspondance where you advised us your would process a refund to the NAB card security team to investigate.
I have also contacted paypal however due to the fact that the transaction came directly from my credit card and not from my paypal account there has been a delay in lodging this complaint.
I have also requested that Craig, the owner of the account cla37 lodge a complaint through ebay.
I suggest that you issue the aformentioned refund as soon as possible to avoid any further investigations.
Please respond to this email address ([email protected]) as [email protected] is not monitored regularly.

这邮件我开始以为是忠于想到要钱了,但又看了看发现丫有点扯皮的意思. 丫之前回我的邮件都很nice,但这邮件纯属混淆事实.
1. 我的ebay油箱从来没有变过,和他联系从来都是一个邮箱, 丫造谣说我换油箱以前东西没看到
2. 丫抓我的鞭子, 我第一封信和他核实地址是说过不得到回复我不会寄东西.但我拍卖里又保证隔天发货.所以最后我是成交后第四天没有任何回音后把东西寄往错误地址了. 丫居然问我没他同意为什么要寄给他.
3. 丫又继续编说我同意退钱去什么nab. 我只说还钱给他paypal,不知又是啥意图
4. 丫换了个邮箱联系我,言语里貌似暗示和C不是同一人.可是我觉得其实他就是自编自演.
5. 搞了一些恐吓的内容,又说要告ebay又要告paypal
反正综上所述.我觉得这家伙这次是跑来耍流氓了.也不知是四个月前编排好了职业耍流氓,还是就为那200多块钱赖上我了.
我回了封信说还钱没问题,不过我最多再做一次paypal refund到曾经付钱的帐户.至于会不会又给退回来与我无关. 再多的请去找ebay和paypal解决.
这点破事折腾了小半年啊, 我倒是无所谓反正全当练英文了. 自始至终觉得对方很匪夷所思.
各位帮忙看看,这里面会不会还有什么玄机.

呵呵 你知道ebay有个60天的政策吗?
60天以后 如果东西就算他没收到 他也没有任何办法把他付的钱拿回去了
所以卖家和买家 处理任何纠纷 都要在60天内解决掉

晕 你有他的email adress啊 当初打钱给你的时候用的, paypal 有个功能较 send money.....你直接钱发过去给这个email地址不就好了。。。。。

我之前弄过一次, 在他打给我钱的那个transaction那里点refund, 可是退款一周后又被paypal取消了,不知道丫的paypal到底有啥问题. 新的进展是,丫跟我说丫没有paypal account,是通过credit card直接付的,把我彻底搞糊涂了

楼主完全不用担心。。。。买家现在已经不再EBAY和PAYPAL cover 之内了
你爱退款就退款,不想退款就当作没有收到任何EMAIL

这种白痴很多,遇到过不少,我也试过类似的
之前还试过一个东西卖了2500+的,挂号寄出去的,买家竟然说包裹里没有产品
当场吐血,赶紧让她去邮局报告这个事情。。。。结果一点回音也没有,我这边跟邮局说,但邮局只接受收件人的报告,无果,只能打电话给EBAY 和PAYPAL,他们向我建议先联系买家,如果联系不上报警
然后通过无数种方式,打电话(ebay 里的竟然是假号码),发邮件,EBAY message, PAYPAL CASE 回复(她也在PAYPAL里开DISPUT)了。。。
然后一个多星期之后在PAYPAL里回复了我,只是重复说没有东西在包裹里,要求我立刻退款。
再打电话给PAYPAL, 客服人员说,这么大金额的交易,他们是不会直接退款给任何一方的,会交给警察处理。。。。听到这个,顿时轻松一些。
然后又过了两个星期,PAYPAL的CASE结束了,钱又回到我们账上,到现在已经过了三个月,再也没有收到这个买家的信息

ebay有dispute处理程序,有麻烦要及时的申请,过了时间就没辙了。

As a common sense, it is the responsibility of buyers to keep prompt communication with sellers to ensure succeeding transactions. Just not like you who lagged one or two months in each response but still expecting that the seller will take care of you all the time. I am not your nanny who are chasing behand you everyday, begging you to provide a right address or accept a refund.
I reviewed the paypal transaction you made, seems like you were not a registered paypal customer, as you told me last time. Also, because the transaction was already past 60 days, the refund tunnel on paypal had been closed. The new refund will go to a nominated account, which you can guarantee that it will be received. The amont of the refund will be the original payment you made minus all the cost generated during the trade which are the shipping fees and ebay & paypal fees ( 263- 14 -20 = 229$ ). After experiencing all of this, i do not want to endure any loss which I was not responsible for.
You should thank me that I still agree to issue a refund to you. Thanks to your delay for several months, you are not indeed covered by either ebay or paypal anymore.
Give me your account to receive the refund.

Dexter,
I have your agreement to refund in writing, so you are legally required to provide follow through with this refund, in either case I can reverse the entire transation through NAB if you decide to cause trouble.
Don't think that because 60 days has passed your responsibility to provide a refund has passed. You are governed by Australian Trade Law which stipulates a statute of limitations as being 6 years in every state except the Northern Territory and even there it is still 3 years. Aside from that you need to check not only Australian Law, but also the ebay guidelines that both state the burden of contact is on the person initiation the transaction with regards to failed funds transfers. Because of this ebay will continue to investigate disputed transactions after 60 days, however I wont be troubling myself with that, if would be seeking investigation through NAB Visa. As for Paypal, that does not even come into it as again I will tell you I DIDNT PAY YOU FROM PAYPAL I PAID YOU FROM MY CREDIT CARD!!!! I am a registered paypal user but this transaction was never paid from a paypal account, and I have never claimed otherwise.
As the seller, ebay and paypal fees are YOUR responsibility. I will agree to allow you to not refund the postage cost as Jess and Craig have already agreed to that however in order for you to pass on any other costs or fees to the buyer you are legally required to obtain written acceptance of your terms of trade as part of which you need to state that the buyer will agree to any additional costs incurred to be passed on.
As you have no such documentation you will have to contact ebay yourself for a refund of any fees ebay has charged you in relation to this transaction. I am willing to assist you with this if you reqire confirmation of an incomplete transaction.
The credit card that you were paid from, where you need to refund the full balance minus the postage charge, is: xxxxxxxxx.
If you are unable to refund the funds to the credit card account where you were paid from. Please deposit the funds into Westpac Australia BSB xxxxxxxxxx.
I don't want to have to keep emailing you about this, I just want you to follow through with the refund that you have previously agreed to provide.
Please let me know as soon as you have transferred the FULL amount minus postage costs to allow me to cease investigations by NAB Visa.

别理他,让他闹吧,过了60天,他不能留ebay差评,不能通过ebay和Paypal要回钱。如果现在退钱是你觉悟高,不是你的责任,他这个态度,不理他。他要是有办法要回钱,算他本事。

LZ从头就失策了。你本来就没责任核对他的地址的,照样寄过去就是了。地址不对也不干你事,发封信告诉他,我给你寄了,退回来了,你得再补足邮费我在给你寄。后来你又主要提出可以退款,你就已经操心过度了。买家看你比他急,那你就没戏唱了。
现在这个尴尬的境地,你要么:
1。不退他钱,让他去闹,现在是他急你不急,你可以坚持说退款可以,但是买家的错误地址造成了损失,你得扣掉。买家要同意,你就给他退,不同意,大家就继续协商,反正你也不急。协商到大家同意了在退款。这样说到哪里你都有道理,退款是同意的,但是细节没有达成一致,所以协商啊。
2。 你要是不想烦了,就干脆吃个哑巴亏,按他说的退给他了事,省了麻烦了。
另外,LZ你的email写的太感情用事,你这是business email,说事就可以了,别提那么多没用的。你看看人家给你的回信写的多好,引经据典,看起来有理有据的。

额,受教了,我是被这丫烦得实在是不行了.
结果是,我钱给他退到他说的帐户了, 金额还是我说的数字.
丫要就那30多块的差价去ebay告我.
因为我在新回他的邮件里,在退款收据上引用了他的正确地址.他继续诬蔑说我一开始就知道他的地址寄错也是我的责任.
闹吧,丫爱咋地咋地去.

兄弟,没经验呀,既然大家都说可以不退了。你就不退了呗。别怕他。等着他闹,等着第三方,ebay呀 ,paypal呀,警察。。。。等受理了这个dispute。有结果了再退也可以。你现在可以这样,你认为已经过60天了,是他的问题,没必要在退给他了。
这种dispute,因为你之前response过,即便最后dispute你失败也不会对你的澳洲credit纪录有任何影响。
