新西兰郁闷的邻居 PRIVATE DRAINAGE WATER

please anyone can help?
Our house is on a cross leased land with my neighbour.
With the recent rain, one of a black pipe starts to pump water directly to the back of our house.
I rang city council and water care a few times, everyone is saying it is private drainage water, should go to ask the neighbour.
My FKing neighbour is saying,'oh it has always been a problem' --- has no inclination of fixing it---.
We have to go to talk to them again tonight, it is a nightmare.
Their house is higher than mine, the pipe is 100% from their house (? maybe the gutter trap) .
Anyone came across this? do we really need to go to a lawyer or through court?
It is very urgent, as it is still linking water when it is good weather

You shouldn't need to pay for it if the pipe is theirs, especially they are the only user.

I had a similar situation recently. We are not cross leased. The neighbour's drainage water flooded our property, negatively impacted our back yard lawn, basement, garage and through the public area in the front street.
I went to asked the council. Basically the council said the property owner, not the council, is responsible for fixing because it is a private pipe. If the neighbour refused to fix it, you can log a complain with the council because it can be an environmental issue. Then the council will deal with them.

I then went to talk to the neighbour directly, made numerous phone calls, text messages, emails etc, etc... The neighbour never refused to fix it but just took their time. When they eventually started fixing, they only went as far as the boundary and left the rest to us.

Because their pipe line run through our property, I believe they should be 100% responsible for the entire pipe. So I sent a formal email to the council, including detailed description of the issue, GIS map screen shots etc. About 2 weeks later, the council called and emailed me. They had clear instruction about what our neighbour should do to fix the pipe. I forwarded the council's email to the neighbour.

About a week later, the neighbour fixed the issue finally. They still got the council's digger came to fix it. I'm not sure why. Maybe the job is too complex for them. But anyway it is done, and I didn't need to pay anything.

They live up the hill, it is fine with them, so they are not in a hurry---

Send a formal letter or email to your neighbour tonight. And let them know you are going to log a complain with the council if they are not taking any action by certain date.

Keep the letter as a tracking record if you do need to complain with the council.

管子总有两个头儿吧 你把一头儿堵上 另一头冒水或是进不去水。不过没看过实际地理情况 也不好说。

不是cross lease当然情况不同了。cross lease不好说，可能需要双方出钱，看情况。

We spent nearly an hour with them tonight. The guys said it was a preexisting problem, it doesnot affect him. Surely he lives on top of the hill, all the water goes into my house, soooo annoying and he doesnot want to pay a penny ======

不用再跟他们说了，去council log a complain.

你就顺着流水的地方挖条沟，把水全部引向driveway，然后流到马路上，council就会让你们修了，然后就一家一半被，反正是crosslease
