小店一间,一月份招了一个FULLTIME 老外,可是他的PERFROMANCE太差,决定炒掉。。
以前的员工都是好来好走,而且都是请亚洲人,这次请的老外,不知道会不会不同。。
如果解聘,需要走什么流程么?有特别要注意的事项么?

When you employ him, did you tell him there's 3 months probation time? If you wanted to dimiss him within probation period, it should be easier than after 3 months. Even he worked more than 3 months, you still could fire him without writing any notice. Just becareful the way when you talked to him. Tried to be more nice and polite. No everyone has time to sue you, including australian employees.
Just called him to your office, and tell him his performance is not up to standard. You don't think he's fitted into your company. Don't have to write down anything to him (avoid of leaving any kind of evidence using by him), just pay off whatever entitlements he's entitled to, and tell him: "you may go now". Be calm, don't argue with him. If he asked why, simply repeat that his performance and the way he worked are not accepted by the office. Remember to issue him a 'separation certificate' for him to apply benefits from Centrelink. You may download this form from Centrelink, and fill it up for him.

Do not fill up the reason in the form that "not enough work". Otherwise, you can not employ anyone else to replace him within half year. he could sue you for unfair dismissal.
Bearing in mind, in Australia, you can "not" fire an employee just because he comes to office late and leave office early; or always taking sick leave or holiday leave.

one question is why we can't fire him for the above reason....
This is one of the reasons I have to fire him as for the past 30 working days, he's running late more than 10 days..some time being late for half hour and some times even one hour.
Of cos his general performance doesn't meet my requirement..
Just feel very curious why we can't fire people because of being late so often....

以后直接雇causal,hourly rate高一点 但是炒人容易 少很多麻烦

8楼说的很清楚也很专业,补充几点:
1. 雇人尽量请CASUAL或PART TIME,尽量不要碰FULL TIME,不然作为雇主有很多LIABILITY;
2. 如果是FT,试用期之内(可以三个月,可以半年,都合法),可以随时DISMISSAL, NO LIABILITY;
3. 如果过了PROBATION,一年之内的,需要给WRITTEN NOTICE(提前至少一周),不需要支付REDUNDANT PAY;
4. 如果满了一年,不满两年的,需要给WRITTEN NOTICE(提前至少两周),炒完以后需要支付等同于四周工资的REDUNDANT PAY。

If the company had less than 15 employees, it would be considered as SME. Then, there's no redundancy pay.

楼主,你家生意一共雇用了几个人?
15个人头以下,你12个月内都可以解雇。不需要理由。
确保,工资是按法定支付的,节假日都按节假日付的,加班要不付了钱,要不给了假。
年假要计算付给人家,养老金都付清了。
好聚好散,不要把人家搞毛,下不来台,关系不要搞僵。

歪个楼啊,如果员工sick leave 给了医生证明。雇主有权利再细问到底怎么病了,哪里病了等等吗?

这个我记得是属于staff privacy的内容,雇主无权询问。所以GP也不需要写staff因为什么原因生病。stress leave应该算是极端典型的了。直接一到两周。什么人也不能问咋回事。
